The pr erty is zoned RR-1B Single Family Rural Residential, requiring a minimum of <br /> 2.0 acre dry buildable land. The remaining dry buildable area of the property after excluding <br /> the permanent MnDOT easement is approximately 1.9 acres. This places the property in a <br /> "legal nnconforming" status, due to substandard lot area. <br /> • <br /> After th easements are acquired, it appears that the existing home will remain conforming <br /> to all re uired structural setbacks, lot coverage limits, etc. <br /> The ramifications of legal nonconforming status are relatively minor; if the house was <br /> comple ly destroyed,a lot area variance would be required in order to rebuild,but a variance <br /> would t have to be obtained to merely construct additions or accessory buildings meeting <br /> all othe standards. <br /> 2. The to porary MnDOT easement appears to be within 25' of the north end of the existing <br /> drainfield lines. This causes no direct impact in itself,as long as all land-disturbing activity <br /> stays wi hin the easements. <br /> 3. Not dir tly related to the MnDOT acquisition is the fact that the existing drainfield system <br /> is "non compliant" due to lack of separation from seasonal water tables and must be <br /> replace by December 31,2010 per City ordinances. We are in receipt of a testing report and <br /> design r a replacement septic system for the property.
