Martineau and Melissa L. Ottinger, husband and <br /> wife (hereinafter "the applicants") are the owners of the property located at 2565 North <br /> Shore Drive within the City of Orono (hereinafter the "City") and legally described as <br /> follo�vs: <br /> Attached as Exhibit A <br /> (hereinafter the "property"); and <br /> WH�REAS, the applicants have made application to the City of Orono <br /> for a variance to Orono Municipal Zoning Code Section 78-1288 to allow a reduction in <br /> hardcover from 21.61% to 21.18% hardcover within the 0-75' setback from the OHWL <br /> of Lake Minnetonka. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of <br /> Orono, Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #04-2981. <br /> 2. The property is located in the LR-lA, Single Family Lakeshore <br /> Residential zoning district, which requires a minimum lot area of 2 acres. <br /> 3. The Planning Commission reviewed this application at a public hearing <br /> held on February 17, 2004 and recommen�ed approval of a hardcover <br /> variance based on the following findings: <br /> a. A total of 2,608 s.f. of hardcover exists in the 0-75' setback zone <br /> where none is allowed. This hardcover consists of a home, deck, patio <br /> and retaining walls. <br /> b. There is currently 21.61% hardcover in the 0-75' setback zone, and a <br /> total of 25% or 7,530 s.f. for the combined areas of 0-75' and 75'- <br /> 250' setback zones. The applicants are proposing to reduce this level <br /> by 52 s.f. <br /> Page 1 of 5 <br />
