� o� <br /> 0 0 <br /> '����a=�- r C ITY of ORON4 <br /> ,� -� � <br /> . �,.: � <br /> �� ��� G~' RESOLUTION OF THE CITY COUNCIL <br /> L�kESII�g'� NO. 5 5 9 9 <br /> A RESOLUTION GRANTING A VARIANCE <br /> FROM MUNICIPAL ZONING CODE SECTION 78-1435 <br /> AND A CONDITIONAL USE PERMIT <br /> PER MUnTICIPAL ZONING CODE <br /> SECTION 78-418 (1) <br /> FILE NO. 06-3199 . <br /> WHEREAS, Minnetonka Center for the Arts, a Minnesota non-profit <br /> organization (hereinafter "the applicant") is the owner of the property located at 2240 <br /> North Shore Drive within the City of Orono (hereinafter the "City") and legally described <br /> as follows: <br /> The South 459 feet of the East 474.5 feet of Goven-iment Lot 5 in Section 10, <br /> Township 117, Range 23 and Lots 2 and 3 and the West 69 feet of Lots 4 and 6 in <br /> Block 3, Markville, Hennepin County, Minnesota <br /> (hereinafter the "property"); and <br /> WHEREAS, the applicant has made application to the City of Orono for a <br /> variance from Orono Municipal Zonin� Code Section 78-1435 and a conditional use <br /> permit per Orono Municipal Zonin� Code Section 78-418 (1 j to allow construction of an <br /> open-sided "kiln shed" to be located between the principal building and the street <br /> �ro�ei�y line where an accessory building is nonna�ly not permitted. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of <br /> Orono, Miruzesota: <br /> FINDINGS - .� ;� - <br /> 1. This application was reviewed as Zoning File 06-3199. <br /> 2. The property is located in the RR — 1B Zoning District which requires a <br /> minimurn lot area of 2.0 acres and a minimum lot width of 2�0'. The <br /> property contains 5.56 acres of area and over 500' of derineii lot widih <br /> along North Shore Drive. <br /> 3. The Planning Commission reviewed this application at a public hearing <br /> held on June 19, 2006 and recomrnended approval of the variance and <br /> conditional use pennit based on the following findings: <br /> Paae 1 of 4 <br />
