Box 45 <br /> Crystal Bay, MN 55323 <br /> July 10, 2001 <br /> Dear Mr. McClelland: <br /> It has come to our attention the fence along the south lot line of your property located at 2170 <br /> Nlinnetonka Avenue has not been relocated to come into conformance «-ith the City's local <br /> ordinances. Last year on, July 24, 2000 the property was inspected where it«�as discovered a new <br /> fence had been constructed in approximately the same location as a fence that had been removed. <br /> Although the City of Orono does not require permits for fences,new fences and replacement fences <br /> are required to meet the current requirements of the Zoning Ordinance. <br /> To review the issue for you, south of your property there is a 33' wide platted right of way that <br /> separates your property from the lot to the south. The 33'is an extension of Minnetonl:a Avenue and <br /> is o�rned by the City of Orono. Your fence appears to be located approximatelv 1 '/z feet outside of <br /> your property lines onto the public right of way for Minnetonka Avenue. In addition, the Zonin� <br /> Ordinance does not permit new fences over 3 %z feet in height to be located within 50 feet of a <br /> property line adjacent to a street. Your new fence measures an average height of 6 feet, where only <br /> 3 % feet is permitted. <br /> The City of Orono is requiring the fence to be removed from the public right of way and reduced in <br /> height to 3 '/z feet,or to relocate the fence to meet a minimum 50 foot setback from the south lot line. <br /> The City of Orono had originally established a deadline of August 21, 2000 to relocate or remove <br /> the fence, it has been nearly one year and the fence has not been relocated. If you do request to <br /> maintain a fence at its current height a variance approval process is required. A variance requires <br /> an application be made to the City of Orono. A deadline has been established of August 22, 2001 <br /> to either bring the fence in question into conformance with local ordinances or you to file a complete <br /> variance application request. , <br /> I have included a copy of the earlier letter mailed to you, dated July 2�,2000.
