Commerce Department Karen Shinkle <br /> 133 Seventh Street E 2425 Maple Lane <br /> St.Paul,MN 55101 Orono,MN 55356 <br /> October 29,2002 <br /> To Whom It May Concern: <br /> On Wed Oct 9,2002 I signed an agreement with Gates Roofing to reroof®utter my home.$1000.00 down payment was made on <br /> that date with final remaining payment to be made upon work completion.The reroofing was done on Sat Oct 12,2002. <br /> During reroofing wood was removed from various areas and several pieces of Styrofoam soffit vents broke off and blew off the roof due <br /> to the wind. To my knowledge these pieces of Styrofoam soffit vents were not replaced.Copy of the price quote is attached.Also copy <br /> of subsequent billing is attached adding only wood.I was told that the reguttering would be done the following week of Oct 14,2002. <br /> I called Nathan on Tues.Oct 22,2002 about the g�tters having not been replaced yet.Nathan advised me that I was inconect and I <br /> advised that I was not paying balance until work was completed.Nathan said to NOT call him;instead I was to call Rick.I called Rick <br /> also on Tues.Oct 22,2002 and left a message that the gutters were not replaced and that I was not going to pay the balance until work <br /> was completed.I also advised that I would be speaking with the Orono building inspector. Rick did NOT retum my call.Both Rick and <br /> Nathan are Gates Roofing employees. <br /> Wed Oct 23,2002 I visited the Orono Building Inspector.There was NO building permit issued! Yet I was charged by Gates Roofing <br /> for the building permit fee.Prior to signing the contract I asked,"Who gets the pern�t?"Nathan(from Gatas)said,"We will get the <br /> permit."I showed copy of the bill charging me for the building permit.T'he Inspector advised he would contact Gates Roofing about <br /> failure to obtain a buiiding permit.At that time I showed him a piece of the Styrofoam soffit vents. (Several pieces of Styrofoam soffit <br /> vents had blown off into my yard and my neighbor's yard)It is still unknown if the soffit vents were replaced since there was no <br /> inspection during the reroofing.There was NO building permit obtained by Gates Roofing. <br /> After visiting the Inspector,Rick(with Gates)left a message on Wed Oct 23,2002 asking that I return a call.Later the same day the <br /> Orono building inspector left a message that he had contacted Gates Roofmg and that the building permit would be assessed a double fee <br /> and that the appropriate state licensing agency would be notified of lack of permit.Also Gates Roofmg advised the Inspector that the <br /> contract was signed on Fri.Oct 11,2002 with roofing being done on Sat Oct 12,2002.Timing was the reason NO building permit was <br /> obtained.Gates was to make necessary vent repairs and roofing inspection was to be properly scheduled with the Inspector. <br /> Contract was signed on Wed Oct 9,2002.Reroofing was to be done on Fri.Oct l 1 but done on Sat. Oct 12.The reguttering was to be <br /> done the followir.g week. I will soon have bank statement and canceled check showing date the check cleared my hank.Bank DATE <br /> CHECK CLEARING of the down payment$1000 check should clarify contract date.Copy to follow upon receipt of the next banking <br /> statement. <br /> I returned Rick's call on T'hur.Oct 24,2002 and had to leave a message:I advised that the Orono building inspector wanted to schedule <br /> an inspection when the venting repair work was being done.Also I advised that if I needed to be on site I would be available the same <br /> weekday that the contract was signed.(I work seven-days a week with two jobs but only work 8:OOPM until midnight on Wednesdays) <br /> To date,Rick has not returned my call. <br /> T'he existing gutters were loosened to repiace the roof. Winter is rapidly approaching!I need my roof to be properly reinstalled.Properly <br /> installed soffit vents is code to ensue roof longevity.I need replacement gutters installed after the roof has passed inspection. <br /> Does Gates Roofing intend to complete the contract?The gutters were not installed the week of Oct 14'�.The dumpster was removed on <br /> Fri.Oct 18,2002.Nathan told me"Do NOT call me!" Rick has failed to discuss issues with me.It is doubtful that the soffit vents were <br /> replaced since it was not listed on the quote or subsequent billing.Dces the roof now met inspection code? <br /> I am concerned about this contract. 1)There was a charge for a building permit by Gates Roofmg which was not obtained.2)There was <br /> no buiiding inspection during reroofing since NO building permit was obtained. 3)Was the roof properly reinstalled:i.e.,was the <br /> necessary replacement pieces of soffit vents installed under the tar paper,ice shield and shingles so that the insulation will function <br /> properly under code?4)Will warranty be valid?5)Will Gates Roofing make needed repairs properly without more rework? <br /> Thank you for your consideration in this matter. <br /> CC Better Business Bureau <br /> CC State Attorney General <br /> CC Orono Building Inspector <br /> Karen Shinkle CC Rick @ Gates Roofmg <br />
