Derry reside at 3559 Lyric Av_—enu in the City of Orono which <br /> I own and which I know to be zoned exc usively for single family residen- <br /> tial use. <br /> I, Albert L. Derry have been operating The A. L. Derry Excavating and <br /> Grading business from my property at the above address, including the <br /> keeping of trucks, trailers and excavating equipment on the property and <br /> including the use of my garage for purposes of repair of such equipment, <br /> which uses I know to be in violation of the zoning ordinances of the <br /> City of Orono. <br /> I, Albert L. Derry have received written notices of such violations from <br /> the City in 1973 , 1974 , 1975 and again on November 16 , 1979 , and i further <br /> admit that I am in violation of some or all of the City ordinances ref- <br /> erenced in said notices . <br /> I, Albert L. Derry hereby agree to cease all non-residential use of my <br /> property at 3559 Lyric Avenue on or before May 31, 1980 and I will <br /> thereafter not keep or store any construction or excavating equipment <br /> or supplies on the property but will use the property solely as my <br /> residence in conformance with the zoning ordinances of the City. <br /> Inreturn for Mr. Derry making this agreement, the City of Orono in turn <br /> agrees not to prosecute Mr. Derry for violation of the above referenced <br /> zoning ordinances unless and until such violations are not corrected <br /> before June 1, 1980. The City reserves the right to enforce all other <br /> ordinances of the City as they apply to similar property in the City and <br /> does not waive its right to prosecute for these same vioiations between <br /> this date and June 1, 1980 if such violations are not corrected by that <br /> date. <br /> The agreement is made and entered into by and between Albert L. Derry and <br /> the City of Orono, a municipal corporation under the laws of the State <br /> of Minnesota, on this llth day of December, 1979. <br /> Witnes Albert L.
