<br /> under the laws of the State of Minnesota{hereinafter referred to as City).
<br /> WITNESSETH:
<br /> Owner,in consideration ofthe sum of One DoIlar($1.00)and other good and valuable
<br /> - consideration to Owners in hand paid by the City, the raceipt and sufficiency whereof is hereby
<br /> ac�an.owledged,do C�rrant,Bargain,Quit Claiun an.d Conveyunto the City,forever,the followingperpetual �
<br /> drainage easement over and under and across properly located in flie County of Hennepin and the State
<br /> of Minnesota, and legaily described in Exlubit A attached hereto; (hereinafter described as Land};
<br /> Said easement includes the free right of�lie City or its agents to enterupon,under and over
<br /> said Land,to remove trees,br�zsh,grass and dirt and other structures therefrom and to constru ct,maintain,
<br /> repair,reconstruct and use drainageways and other improvements related thereto,and to eirter upon s aid
<br /> easernent forthe purpose of mspecting,repairing,removing and reconsLructirig such facilities. The Ciiy shall
<br /> return the area it disturbs to grade and seed the same and replace the surface soil with the original type
<br /> material.
<br /> Tiie Owners agree to the following:
<br /> A. No trees,shrub s or other vegetation sha11 be destroyed,cut or removed from the
<br /> Land except as authorized by written consent of City.
<br /> B. No earth,ioam,peat,gravel,soil or any other natural material or suhstance sha11
<br /> be moved or removed from the Land and there shall b e no dredgirig rn excavation
<br /> of any izatut�e whatsoever or any change o f the topography of the Land without the
<br /> written consent of City.
<br /> C. No soil,sand,gravel,or other substance or material as landfill shall be placed,
<br /> . dumped or stored uponthe Land and no waste,trash or garbage shallbeplaced,
<br /> dumped or stored upon the Latid.
<br /> D. No use shall be made of the Lan.d except uses,if any,which will not change or
<br /> alter the natural condition of the Land,and no use which would tend to change the
<br /> drainage,flood control,water conservation,erosion contral,soil c,onservation,f[sh
<br /> � andwildlifehabitatcharac�eristics shallbemade oftheLandorfhewatersituated
<br /> thereon.
