Clt� of ORO1�0 <br /> l. . <br /> RESOWTION OF THE CITY COUNCIL <br /> NO. 1621 <br /> • <br /> � � • • <br /> A RESOLUTION APPROVING THE PLAT OF <br /> KELI�Y COVE <br /> WHEREAS, the City of Orono is a municipal corporation <br /> orgainzed and existing under the laws of the State of Minnesota; and <br /> WHEREAS, the City Council .of the City of Orono has adopted <br /> subdivision regulations for the orderly, economic and safe development <br /> of land within the City; and � <br /> WHEREAS, the City Council has considered the application for <br /> a subdivision plat by Daryle L. Uphoff, the subdivider; and <br /> WHEREAS, the subdivider has completed all requirements of the <br /> platting regulations of the City including: <br /> 1 . Dedication on the plat of drainage and utilities easements <br /> � 2 . Creation of private covenants to assure the continued <br /> upkeep and maintenance of all shared improvements located <br /> within Outlot A, Kelly Cove <br /> 3 . Payment .to the City for outstanding sewer and water charges <br /> not collected at the time the property was originally <br /> subdivided in the amount of $935.00 <br /> 4 . Payment to the City for. the legal review and filing of the <br /> final plat and private covenants in the amount of $75.00 <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of the <br /> City of Orono hereby approves the plat of Kelly Cove, Hennepin County, <br /> Minnesota, subject to the following conditions: <br /> 1. A single family detached dwelling may not be constructed <br /> on Lots .l, 2, 3, & 4 , Block 1, Kelly Cove <br /> 2 . Outlot A, Kelly Cove, may never be used for future <br /> residential construction, but shall remain as an open <br /> space area as density credit for existing duplex units <br /> on Lots 1, 2, 3, & 4 , Block 1, Kelly Cove. .Residential <br /> docks may. never be constructed on the shoreline of Outlot A, <br /> Kelly Cove <br />
