The City had previously indicated that no Certificate of Occupancy could <br /> be issued until the bluff restoration and revegetation is completed. <br /> On October 3, Zoning Administrator Jeanne Mabusth and I met with Todd Irvine of Arteka and the <br /> Streeters, and agreed to the restoration and replanting plan by Irvine dated 9/22/94. Irvine further <br /> indicated that due to the nature of River Birch, planting this fall would place them in jeopardy of <br /> survival and he sug�ested they be planted in the spring of 1995. <br /> The City agreed to that schedule subject to the property owners executing a restoration agreement and <br /> providing acceptable security to ensure the tree planting will be done in a timely manner, so that a <br /> Certificate of Occupancy can be issued this fall. Therefore, accompanying this letter is a draft <br /> Restoration Agreement to be executed and accompanied by the appropriate Letter of Credit. In lieu <br /> of a L.etter of Credit, the City will accept a Certificate of Deposit per the format attached. A third <br /> alternative would be providing a Cashier's Check payable to the City of Orono. However, the City <br /> will not pay interest on such a deposit. <br /> Today the grade restoration and slope aroundcover was inspected and found acceptable.
