� ° � 0 0 � � C ITY of ORON4 'a a�� °,�;��' c� ti RESOLUTION OF THE CiTY COUNCIL ��kESYiO��G NO. �J S � � A RESOLUTION GRANTING A VARIANCE TO THE ORONO, MINNESOTA, CITY CODE SECTION 78-1435 FILE NO. 09-3399 WHEREAS, Dean Trongard and Susan M. Trongard, husband and wife, (hereinafter "Owners") are the owners of the property located at 1240 Garden Court within the City of Orono (hereinafter "City") and le�ally described�as: Lot 71, Tonkaview Gardens, Hennepin County, Minnesota (hereinafter "the Property"); and WHEREAS, in order to replace the flat roof with a pitched roof the Owners have made application to the City for a variance to Orono Code Section 78-143� to enlarge an accessory structure that is located closer to the street than the house, when the code does not allow accessory structures to be located closer to the street than the principal structure; and WHEREAS, a�ter due published notice and mailed notice in accordance with Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held a public hearing on April 20, 2009, at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS L This application was reviewed as Zoning File #09-3399. 2. The Property is located in the LR-1B zoning district, where 1 acre is the minimum lot area and 140 feet is the minimum lot width. The Property is approximately 0.94 acre in area and 149 feet in width. 3. The Planning Commission reviewed this application on April 20, 2009 and on a vote of� - 0 recommended approval of the variance, based on the following findings: a.
