I can meet with you and John Adams tomorrow (Tuesday) at 9:00 a.m. or 2:00 p.m.; <br /> Wednesday at 10:00 a.m. would also work. <br /> The Notice of Decision received from Courtney Hall indicates that the MCWD accepts the location of the delineated <br /> boundary between wetland and upland, and accepts the classification of the two types of wetland on the property. <br /> However, it does not make any conclusion as to whether the wetlands are contiguous with the OHW of Lake <br /> Minnetonka for City zoning purposes. <br /> We met with Brandon Wisner of MCWD on July 22 and discussed this with him. He agreed that based on the channel <br /> connecting the open lake with the wetland, it is entirely possible that the 929.4 OHW contour extends into the wetland. <br /> From a zoning standpoint, we have evidence (topographic surveys) for both properties immediately west of yours(980 <br /> and 1070)that shows the 929.4' contour at or near the wetland/upland boundary, and both those homes were required <br /> to meet the 75' setback from the 929.4' contour. For the property at 960 West Ferndale,the 929.4' contour is not <br /> shown on the Anderson Engineering survey on file. Until that information is provided, we cannot make a conclusion as <br /> to whether your setbacks would be based on 1) 75'from the 929.4' contour or 2) based on 20' setback from the upland <br /> edge of whatever wetland buffer is required by the MCWD.
