g-��O <br /> C ITY OF ORONO <br /> I�ESOLUTION OF THE CITY COUNCIL <br /> � �` 65r3 <br /> �'� G' N o. <br /> qkFSHo�� <br /> A RESOLUTION ORDERING <br /> REPAIR OR REMOVAL <br /> OF HAZARDOUS CONDITIONS <br /> WHEREAS,the Building Official for the City of Orono has attempted without success to have <br /> the owner of certain property remedy the hazardous and unsafe condition of the uninhabitable house <br /> situated on properiy at 1735 Fagerness Point Road,Orono, Minnesota located in the County of <br /> Hennepin("Subject Property"); and <br /> WHEREAS,the City Council has deternuned that the building on the Subject Property <br /> constitutes a hazardous building and is a health and safety hazard within the meaning of Minn. Stat. <br /> § 463.15, subd. 3. <br /> NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br /> THE CITY OF ORONO, MINNESOTA: <br /> 1. The City has fully considered all evidence relating to the code violations at the Subject <br /> Property. Said evidence includes(i)an Adiniiustrative Search Warrant regarding the <br /> Subject Property which was executed on October 13,2015; (ii)a letter dated August 11, <br /> 2015 from the City of Orono's Building Official to the property owner stating the <br /> numerous hazardous conditions and City Code violations requiring immediate <br /> attention; and(iii)additional photographs taken and date stamped 10/13/2015. <br /> 2. After fully considering all of the reports,photogaphs,documents,and other evidence <br /> pertaining to the code violations at the Subject Property,the City of Orono finds: <br /> a. Toney Williams is the owner of the Subject Property and that there are no <br /> liens on the Subject Property. <br /> b. The City of Orono has notified the owner of the code violations on numerous <br /> occasions and most recently on August 11,2015. No pernuts have been issued <br /> for repairs and no visual improvements have been made to the Subject Property. <br /> c. The Subject Properiy,which is located in Hennepin County,contains hazards to <br /> public health and safety and is therefore a Hazardous Property within the <br /> meaning of Mim1. Stat. §463.15, subd. 3. <br /> d. The Subject Property is vacant and unsecured from trespass because the back <br /> door is broken, the windows are broken, and the front door is unlocked. <br /> e. The roof of the Subject Property contains several large holes causing <br /> structural deficiencies due to water damage and constant exposure to the <br /> elements. <br />
