As things sit <br /> now, the ove�flow would run directly into rr�y yard, which is acrass the street. I <br /> understand that tha city is planning to dev�lop a ditch �nd culver# system on the <br /> builder's side of the road_ Jean told me that this may b� done nex� spring. WWY ARE <br /> YaU ALLaWING CONSTRUCTION TO BEGIN BEFQRE THE DRAINAG� <br /> SaLUTI�NS ARE CbMPLETELY IN PLACE? 1 am very coneemeci about this, and <br /> would like this salution implerr�ented this fall. (Wouldn't it have made sense to h�ve <br /> this completed before issuing a construction permit? ! had to have my swale excavated <br /> before the ci#y would allow me to pour my foundation for my garage fast fa>>. Why is <br /> there a change in policy here?) <br /> i want t� remind you that the swale an my prop�r�y, which t�orders the P�Im property, is <br /> NQT to solve runoff pr�blems in the neighborhooci, and neither the city nor the builder <br /> across th� str��t has �+a legal right to divert water to my property. I wa� required to <br /> construct th� swale to replace a small "ffoodplain" area filled in fo build the northern <br /> edge of my garage. There is a small three inch pl�stic pipe from my swale to the ditch <br /> on the r�orthern side of the Pa1m prope�ty. This is the result aF a friendly agreement <br /> betw�en T�m Palm and myself to move water from my swale to (eventually} the I���_ I <br /> WILL NOT ACCEPT RUNOFF �R4M THE BUILDER'S PROPERTY 1NTQ MY 5WALE_ <br /> The �ity does nat have an Easement ta d� this. <br /> Incidentally, 1 �nderstanci that there is no easement along the I�aImlTrainQr prc�perties, <br /> therefore those two property owners have no ciuty to cooperate with the city's plans tQ <br /> divert water firom the bualder's praperty onto #��ir properties and e�entually to th� lake. <br /> You may want t� talk to Mr. Palm about this. <br /> Please call me about this issue immediately.
