J <br /> ,� ,. . <br /> � � c�t� o� oR,oNo <br /> • RESOLUTION OF THE CITY COUNCIL <br /> � NO. 2117 <br /> • - • � <br /> A RESOLDTION VACATING AN IINUSED PORTION <br /> OF A DEDICATED DRAINAGE EASEMEIJT <br /> AT 2020 AND 2080 SALEM CODRT <br /> WITHIN THE PLAT OF DICREY I�ARE ADDITION <br /> SECTION 27, TOWNSHIP 117, RANGE 23 <br /> IN THE CITY OF ORONO, MINNESOTA <br /> FILl3 NO. 1097 <br /> � <br /> WHEREAS, the City of Orono is a municipal corporation organized <br /> and existing under the laws of the State of Minnesota; and <br /> WHEREASr on December 19, 1987, Van Eeckhout Building Corporation, <br /> on behalf of Roger and Connie Plank and Gary Roderick Construction, Inc. <br /> filed a petition with the City of Orono requesting the vacation of a <br /> portion of drainage and utility easements originally dedicated within the <br /> plat of Dickey Lake Addition, legally described as follows: <br /> The east 5.00 feet of Lot 2, Block 1, DICKEY LAKE ADDITION, according <br /> to the recorded plat thereof, Hennepin County, Minnesota lying <br /> • northerly of the southerly 10.00 feet and southerly of the north 5.00 <br /> feet thereof. Also: <br /> The west 5.00 feet of Lot 1, Block 1, DICKEY LARE ADDITION lying <br /> norther].y of the southerly 10.00 feet and southerly of the north 5.00 <br /> f eet thereof. <br /> WHEREAS, after due published and posted notice, a public hearing <br /> • was held before the City Planning Commission on January 20, 1987, regarding <br /> said vacation and all persons interested were given an opportunity to be <br /> heard; and <br /> WH]3REAS, after due standing and consideration, the Planning <br /> Commission recommended approval of the requested vacation and the Council <br /> of the City of Orono finds that said vacation, as proposed, is in keeping <br /> with the public interest in consideration of the following findings: <br /> 1. The vacation does not affect access to or use of any adjoining <br /> property. <br /> 2. The City has not and does not intend to develop, improve or use <br /> the portion of dedicated drainage and utility easement described <br /> above. <br /> 3. The portion of dedicated drainage and utility easement as it <br /> exists serves no public purpose. <br /> • 4. The portion of dedicated drainage and utility easement, as � a <br /> result of a recent lot line rearrangement no longer coincides with the <br /> boundary between the properties at 2020 and 2080 Salem Court. � <br /> Page 1 of 2 <br />
