� �� <br /> O � <br /> ������.;- CITY o� ORONO <br /> � � , �., <br /> b��v,.�... <br /> ,� �` G'�' RESOLUTION OF THE CITY COUNCIL <br /> �`9kEsi3�4� N0. � � n � <br /> A RESOLUTION GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE <br /> SECTIONS 78-1279(1), 78-1279(6) AND 78-1288 <br /> FIL� NO. 06-321� <br /> WHEREAS, Todd Schaible and Michelle Schaible, husband and wife <br /> (hereinafter "the applicants") are the owners of the property located at 1450 Chen•y Place <br /> within the City of Orono (hereinafter the "City") and legally described as Lots 6 and 7 <br /> Block 4 and that part of the east half of Cherry Avenue vacated laying Northerly of <br /> Westerly extension of the Southerly line of Lot 7 and Southerly of a line runnina from the <br /> Northwest corner of said Lot 6 to the Northeast corner of Lot 5 Blocic �, all in Crystal <br /> Bay View, Hennepin County, Minnesota (hereinafter the "property"); and <br /> WHEREAS, the applicants have made application to the City of Orono <br /> for a variance to Orono Municipal Zoning Code Section 78-1279(1) to allow the portion <br /> of the existin�house, porch, and deck within the 75 foot lakeshore setback to remain as <br /> constructed in conjunction with a proposed t�vo-story addition; and <br /> WHEREAS, the applicants have made applicatioii to the City of Orono <br /> for a variance to Orono Municipal Zoning Code Section 78-1279(6) to allow construction <br /> of an addition forward of the average lal:eshore setback; and <br /> WHEREAS, the applicants have made application to the City of Orono <br /> for variances to Orono Municipal Zonin� Code Section 78-1288 to allow 13 percent <br /> hardcover in the 0-7� foot zone when no hardcover is allo«-ed and to al1o� 3� percent <br /> hardcover in the 7� -250 foot zone «�hen 2� percent is allowed; and <br /> WHEREAS, after due published notice and mailed notice in accordance <br /> with Minnesota Statutes and the City of Orono Zonin� and Plannin� Codes, the Orono <br /> Planning Conunission held a public hearina on Au�ust 21, 2006, at ���hich tiznes all <br /> persons desirin� to be heard conceinina this application were given the opportunity to <br /> speak thereon. <br /> NOW, THEREFORE B� IT RESOLV�I) by the C1tV COL1I1C11 of <br /> Orono.
