Bauman (hereinafter "the applicant") is <br /> the owner of the property located at 1040 Tonkawa Road within the C�ty <br /> of Orono (hereinafter "City") and legally described as follows: . <br /> Lot 10 and that part of Lot 9 lying Northerly of the following <br /> described line and its Easterly and Westerly extensions: <br /> Beginning at the point of intersection of the Westerly line <br /> of said Lot 9 with a line drawn parallel with and 140 feet <br /> South, measured at right angles, from the North line of said <br /> Lot 10 ; thence East along said parallel line 35 feet; <br /> thence def lecting left 4 degrees to an intersection with a <br /> 1 ine drawn para 11 e 1 with and 111 f eet South, measured at <br /> • right angles, from said North line of Lot 10 ; thence East <br /> along said last-described parallel line to the Easterly line <br /> of said Lot 9, and there ending, <br /> ' all in Auditor's Subdivision Number 217, Hennepin County, <br /> Minnesota according to the recorded plat thereof: the Northerly <br /> line of said Lot 10 is marked by Judicial Landmarks set pursuant <br /> to Torrens Case No. 17306, (hereinafter "property"); and <br /> WHEREAS, the applicant has applied to the City for a <br /> variance to Municipal Zoning Code Section 10.22, Subdivision 1 to <br /> permit the construction of an attached enclosed pool which will en- <br /> croach 15' into the average lakeshore setback, and a variance to <br /> Section 10.22, Subdivision 2 to allow 39.4$ hardcover in the 75-250' <br /> lakeshore setback zone where only 25� hardcover is normally allowed. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Counci 1 of Orono, <br /> Minnesota: <br /> FINDINGS <br /> l. This application was reviewed as Zoning File #987. <br /> 2. The property is located in the LR-1B Single Family Lakeshore <br /> Residential Zoning District. <br /> • 3. The Orono Planning Commission reviewed this application on <br /> November 18 and December 16, 1985, and recommended approval of <br /> the proposed variances based upon the following findings: <br /> A) Applicant has a hardship in that there is no other <br /> feasible location for the pool addition. <br /> Page 1 of 4 <br />
