Boz 66
Orono, MN 55356 Crystal Bay, MN 55323-0066
May 8, 2009
To Whom it May Concern:
RE: 445 Brown Road South —Zoning Compliance
The above referenced property is zoned RR-1 B, One Family Rural Residential District, requiring a
minimum lot size of 2.0 acres and 200 feet of width at the right-of-way. The property has an existing lot
area of 9.97 acres and approximately 333 feet of defined width per Hennepin County tax records.
Principal structure setback requirements are 50 feet from the front and rear property lines and 30 feet
from the side property lines. There are additional setbacks and restrictions due to the wetlands on the
property as well.
History
According to the Minnesota Pollution Control Agency www.pca.state.mn.us, the above address is also
known as the Smith Dump and is classified as an Unpermitted Dump Site.
Unpermitted Dump Sites
The list of Unpermitted Dump Sites was created in the 1980's and was originally called
the Open Dump Inventory (ODI). Sites maintained in this list were later referred to as
Outstate Dump Inventory (ODI) and Metro Dump Inventory (MDI) sites. Because these
sites are no longer open the name has been changed to Unpermitted Dump Sites and
contains dump sites for the entire state. Included in the list are abandoned dumps,
demolition sites, tree disposal sites, industrial dumps and other dumps. Most of these
sites existed prior to the creation of the MPCA in 1967, and detailed information about
them is not generally available. When these sites are investigated and found to present
a risk to human health or the environment, they are moved into the appropriate cleanup
program. For more information, contact the MPCA at 651-757-2548, or toll-free at
1-800-657-3864.
Before questions like, "Can the property be subdivided?", "Where can I build?", or "What about septic
sites?" can begin to be answered, the City of Orono will require a written statement from the MPCA
stating their position on the Unpermitted Dump Site.
Prepared by:
Christine Mattson
Planning Assistant
952-249-4620
w:\street files\brown road s\445zoning compliance Itr.doc
Telephone(952)249-4600 • Fax(952)249-4616
www.ci.orono.mn.us
