The property in question does not comply with the zoning district <br /> requirements in several respecCs. The zoning district is RR-1B, which is One Family Rural <br /> Residential. This district requires a minimum lot size of two acres, front and rear yard setbacks of <br /> 50 feet, side yard setbacks of 30 feet and a minimum width of 200 feet. <br /> The subject property is slightly over one acre in size, has a side yard of 25 feet on the south side and <br /> is 150 feet wide. These measurements are all significantly less than this zoning district allows. The <br /> attached sur��ey shows the lot dimensions in detail, as well as the required setbacks. Unless the size <br /> of the house is increased, these shortcotnings should not be problematic in allowing rehabilitation. <br /> The most serious code violation affecting this property is the nonconforming septic system. 'The <br /> current septic tank has not been pumped since 1978 despite several orders by the city Septic Systems <br /> Inspector to do so. The most recent inspection in 1995 found the current system to be failing and <br /> its replacement is required by December 31, 1997. It is recommended that funds granted to the <br /> owner first be used toward a new septic system before any repairs to the house are made. <br /> Also enclosed you will find the definition of "Lot of Record" from the city code.
