Seibold (hereinafter "applicant" ) has made <br /> application to the City of Orono (YLereinafter "City") to permit construction of a <br /> residential dock on a property located at 1699 North Farm Road and legally <br /> described as Lot 5, Block 1, The Farm at Long Lake, hereinafter "property" ; and <br /> WHEREAS, the applicant has applied to the City for a variance to <br /> municipal zoning code section34. 352to permit the construction of a residential <br /> dock on a property that contains 170 feet of shoreline instead of the required 200 <br /> feet of shoreline and to seek Council ' s permission to amend a Flowage and <br /> Conservation Easement and Waiver of Damages dated April 17 , 1978 , that forbid the <br /> construction of a residential dock on said property. <br /> NOtio�, THEREFORE BE IT RESOLVED, by the City Council of Orono , Minnesota : <br /> FINDINGS <br /> . 1. This application was reviewed as zoning file no�. 698 . <br /> 2. The property is located in the LR-lA Single Family Lakeshore <br /> Residential Zoning District. � <br /> �.- �:' <br /> 3. The proposed lakeshore use of the property shall be limited to a 10 ° <br /> foot stripof the total 170 feet of shoreline for swimming , boating , <br /> and other appropriate lake uses; the residential dock shall not <br /> . exceed 6 feet in width or 100 feet in length and shall be for the <br /> exclusive use of the owners and their guests . . � <br /> 4 . The Orono Planning Commission reviewed this application on August <br /> 16, 1982 and recommended approval of the variance as proposed based <br /> upon the following findings : <br /> a) The prcposed limitations on the use of the lakeshore of this <br /> propertyfinds thisvariance request in keeping with the intent <br /> of the ' environmental standards of the Zoning Code and <br /> Comprehensive Plan. � <br /> b) The proposed level of use on this property is consistent with the ' <br /> use of lakeshore on surrounding properties. <br /> 5. The City Council has considered this application including the <br /> findings and recommendations of the Planning Commission, reports <br /> by City staff , comments by the owner and other interested persons , <br /> � and the effect of the proposed variances on the health , safety and <br /> welfare of the community. <br />
