LEHMAN , <br /> TO APPLY FOR A BUILDING PERMIT <br /> PRIOR TO FINAL SUB�IVISION APPROVAL <br /> WHEREAS, the Planning Commission and Council have reviewed and <br /> approved a preliminary subdivisionfor Edward T. Lehman, hereafter applicant , on <br /> June 13 , 1983 , and <br /> WHEREAS, the City has conditioned final approval of the subdivision <br /> upor. authorization of a sewer project that would serve three of the five lo�s <br /> within the subdivision; and � <br /> WHEREAS , the applicant hasfulfilled all of the conditions setforth at <br /> preliminary approval ; and <br /> � WHEREAS, the City has asked to delay final approval of the subdivision <br /> so that the final plat drawings may be amended to include utility .easements <br /> designating the proposed sewer lines; and <br /> WHEREAS, the applicant has asked Council to approve a building permit <br /> for Lot 4 prior to final subdivision approval . <br /> NOW, THEREFORE, BE IT RESOLVED, that the Ci�ty Council hereby approves <br /> the request of Edward T. Lehman to apply for a building permit prior to final <br /> subdivision approval subject to the following conditions : <br /> 1 . Prior to the issuance of a building permit, applicant must submit a <br /> survey designating the location and setbacks of the principal <br /> structure and driveway. <br /> 2. All construction shall be subject to the requirements of the State <br /> Building Code. • <br /> 3. A certificate of occupancy wiil not be.issued until the residence <br /> is connected to municipal sewer and the plat has received final <br /> subdivision approval . <br /> 4 . The applicant hereby agrees to assume full risk in applying for a <br /> building permit prior to resolution of the issue of sewering to <br /> adjacent propertiesand that the City issues this building permit with <br /> the knowledge that sewer is already available to Lot 4 through an <br /> existing sewer line. <br /> ir <br />
