REQUESTED MODIFICATIONS TO DEVELOPMENT CONTRACT <br />SOUTHWAYS PROJECT NO. 18-3998 <br />1. Background- The development contract was approved June 11, 2018 as part of the <br />Southways Final Plat City Council action. Subsequent to that approval the Orono City <br />Council also approved the construction of a new home at 1400 Bracketts Point Road on <br />Lot 5 of the approved subdivision. The development work is nearing completion as of the <br />end of July with only landscaping (boulevard trees, east and west side of the new <br />roadway) and the wear course plus the as-built plans remaining. In parallel, the new <br />home construction, after the demolition of the previous residence, is well underway with <br />construction activity all along the property line and three separate entrances. The new <br />home excavation will require about 11,000+ cubic yards of export over a 2-3 week period <br />starting in September (this start date is best case). This equates to 750-800 dump truck <br />loads of dirt to be removed along the new roadway. The City has also recently approved <br />a mill and overlay project for the 800+ feet of old entry roadway that ties into the new <br />roadway recently built. The DA requires the wear course to be applied between 8/15 and <br />9/15 after one freeze/thaw cycle. <br />2. It makes no sense to apply the wear course and overlay and then immediately subject <br />the surface and edges to this volume/type of heavy truck traffic. The plan for the <br />remaining landscape efforts is to plant the west side of the new roadway with the <br />boulevard trees as soon as possible and then plant the east side after the export activity <br />is completed, weather permitting. <br />3. It is requested that the time period to apply the wear course be revised and extended to <br />November 15, 2019, subject to favorable weather conditions.
