0 <br />C� <br />439"411 <br />RESOLUTION NO. 919 <br />A RESOLUTION VACATING A PORTION OF IVY PLACE <br />WITHIN THE CITY OF ORONO, MINNESOTA <br />WHEREAS, the City of Orono is a municipal corporation <br />organized and existing under the laws of the State of Minnesota; and <br />WHEREAS, the City of Orono has received a petition to vacate <br />a portion of Ivy Place, platted in Spring Park Addition; Lake Minnetonka, <br />Hennepin County; and <br />WHEREAS, after due published and posted notice, a Public <br />Hearing regarding said vacation was held before the Orono Planning <br />Commission on June 26, 19781, and all interested persons were given an <br />opportunity to be heard; <br />NOW, THEREFORE, BE IT RESOLVED, that the Orono City Council, <br />after due study and consideration, hereby makes the following findings <br />of fact: <br />1. That the road to be vacated is in fact not open to <br />the public but is and has for many years been a <br />portion of the yard area of Lot 57, Spring Park Addition. <br />2. That the road to be vacated has for many years been <br />shown on the official plat map of Hennepin County <br />as a vacated road. <br />3. That the request for this vacation stems from a title <br />search by Richard Putnam, owner of Lot 57, Spring Park_ <br />Addition, which search failed to show proper recording <br />of this vacation in previous years. <br />4. That the remaining portions of Ivy Place have been <br />vacated by Hennepin County District Court, Case <br />No. 321350, Order of the Court entered on November 3, 1931, <br />and filed on December 1, 1931, in Book 306 of Miscellaneous <br />Documents page 297. <br />5. That all other properties which may have been affected by <br />this vacation have recorded private easements providing <br />for access to the public road and all owners of said <br />properties have signed the petition in favor of this <br />vacation. <br />
