RESOLUTION #907 <br />A RESOLUTION VACATING ALL OF PARTENWOOD LANE <br />IN THE CITY OF ORONO, MINNESOTA <br />WHEREAS, a majority of the owners of the property abutting <br />on Partenwood Lane in the Development of Partenwood, all within the <br />City of Orono, have requested the City Council in a Petition, dated <br />November 11, 1977, to vacate such street in accordance with law; and <br />WHEREAS, after due published and posted notice a public <br />hearing was held before the City Council on February 23, 1978, <br />regarding the Petition to Vacate Partenwood Lane, and all persons <br />interested were given an opportunity to be heard; and <br />WHEREAS, after due study and consideration, the City <br />Council of the City of Orono finds that it will be for the best <br />public interest to approve such vacation;' <br />NOW, THEREFORE, BE IT RESOLVED, that such Petition is hereby <br />granted and the said Partenwood Lane, as described on that certain <br />Plat of Partenwood, filed of record under date of December 22, 1972, <br />is hereby vacated subject to the following conditions and reservations: <br />1. That the said City of Orono reserves for itself an <br />easement for ingress and egress over the entire area <br />vacated for the purpose of installing, maintaining, <br />inspecting, repairing, replacing or servicing any public <br />utility now or hereafter located within such area; <br />including but not limited to, public sanitary sewer, <br />storm sewer, water mains, gas, electric power or telephone, <br />and that the owners of lots 4, 5, and 6, block -2, Partenwood <br />and lot 2, block 3, Partenwood grant to the City and file <br />in the chain of title of said lots an easement to this effect. <br />2. That the City of Orono reserves the right to, at some <br />future time, reopen the said Partenwood Lane, providing <br />there is at that time a showing of public need and that <br />all of the procedures required by law for the establishment <br />of streets shall be followed. <br />3. The preservation of any presently existing utility <br />easements. <br />4. Preservation of any sewer assessments presently outstanding <br />against any property fronting or abutting said Partenwood Lane. <br />0 <br />
