A RESOLUTION MODIFYING RESOLUTION NO 1198 AND ATTACHED ASSESSMENT ROLL FOR SEWER PROJECT 80-1 AND 80-2 WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for the designated sewer project of Minnetonka Bluffs, t�Jest Ferndale, Orono Lane, and County Road #15 area (80-1) and Scotch Pine Lane, North Shore Drive (80-2) ; and WHEREAS, the City Council has approved an assessment roll attached to Resolution No. 1198 on September 8, 1980; and WHEP,EAS, the City Council has had the benefit of reviewing new bids on portions of the project which in two cases are lower than prior bids and therefore desires to pass those savir�gs on to the af;ec�ed property owners; and � �dOI�J THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CiTY OF ORONO, I�IINNESOTA: 1. The original assessment, a copy of which is attached to Resclution No. 1198 and made a part thereof, is hereby amended in part by reducing the special assessments for certain properties to the lesser amounts as shown on Exhibit B attached hereto. The . lesser of the amounts of special assessment for each property shall constitute the spec�al assessment against the`lands named therein, and each tract of land therein included in hereby found to be benefited by the proposed improvement in the amount of assessment � levied against i±. 2. Such original assessment and reduced assessment shall remain payable in equal annual installments extending over a period of 15 years, tne first of the installmenis to be payable on or before the first Monday in January, 1981 , and shall bear ir�terest at the rate of 9 1/2 per cent annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1980. To each subsequent installment when due shall be added interest for one year on all unpaid installments. � 3. The owner of any property so assessed may, at any time prior to certification of the assessments to the county auditor, pay ihe whole of the assessment on such property, with interest accrued to the date of payment, to the city treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of the original assessment roll ; and he may, at any time PAGE 1 OF 2
