Minnesota 55323•Municipal Offices <br />On the North Shore of Lake Minnetonka <br />December 14, 1990 <br />Mr. & Mrs. David Jellison <br />2765 Kelly Avenue <br />Excelsior, MN 55331 <br />Re: Septic system setback - 4750 Creekwood Trail <br />Dear Mr. & Mrs. Jellison: <br />Steve Weckman and I have discussed all the communications we <br />have had with you and your contractor and we felt that a letter <br />of clarification is in order. <br />The Orono septic system ordinances require a minimum 10* <br />setback between septic tanks and any structure, including house, <br />deck, patio, pool, gazebo, etc. However, in perhaps 30% of new <br />installations we encounter, when the tanks are only located 10* <br />from the house, other encroachments such as decks and patios <br />often appear overnight and limit or eliminate reasonable access <br />to the tanks. Therefore, we endeavor to suggest that structures <br />be kept 20* away from the tanks to leave a buffer for future <br />developments, although we can't legally enforce anything more <br />than the 10* minimum. <br />In discussing with your builder the existing location of the <br />tanks, I have made it clear that there is no technical reason why <br />the tanks cannot be moved to a location that won*t conflict with <br />your pool/patio/gazebo plans. The only limiting factor is that <br />if the sewer pipe leaving the house is at the west end, it <br />probably would be a major undertaking to reroute inside plumbing <br />to exit at the east end of the house. <br />I hope this clears up any confusion we may have caused by <br />giving you to apparently conflicting setback standards.
