Box 66 <br />Crystal Bay, MN 55323 <br />Dear Ms. Mabusth: <br />Our client is considering purchasing a residential building site on the west side of Brown Road immediately <br />adjacent to the south right-of-way line of the Luce Line Trail. Long Lake Creek runs through the property. <br />A major portion of the property is designated wetland. The various setback requirements reduce the <br />buildable area to a relatively small portion of the site. <br />Before finalizing the purchase of the property our client wants to determine the soil conditions in the <br />location of the proposed house and the existence of areas large enough for septic treatment within the <br />boundaries determined by setback requirements. <br />It is my understanding that the foundation line of the house must be a least 50'-0 ’ from the front property <br />line, 30*-0'' from side property lines, lOO’-O* from the creek and 26’-0* from wetlands and that roof <br />overhangs can extend a maximum of r-6 ’ into the setback areas. Also, I understand, that the septic <br />treatment area must be at least 20’-0* from property lines, 75 ’-0* from wetlands, 75 ’-0* from the creek <br />and 20’-0* from the foundation line of a b' ilding. The enclosed site plan drawing dated 18 January 1994 <br />was prepared to illustrate the setback requirements for a structure and septic treatment areas on this <br />particular site. <br />The Hennepin County Highway Department has indicated that the location of driveway access to the site <br />is acceptable at the approximate location shouu on the drawing. <br />The house has not been designed. Its size and plan configuration will change as the scheme is developed. <br />The location and configuration of the driveway will probably change with the design of the house. <br />We are seeking confirmation from you that our understanding of the setback requirements for this site is <br />correct.
