I am also enclosing a
survey apparently used to procur a building permit for a garage on
the described property.
The survey shows the existi-A garage. I believe that the
existing garage was destroyed and a new garage erected, which, I
believe, nets approximately 10 feet north of the southerly line of
the northeast half of the lot, and approximately 10 feet back from
the southwesterly line of the northeasterly half of the lot. I do
not have an as -built survery.
It is my understanding that the existing newer system
terminates at approximately the southwesterly line of the lot at the
termination of Birch Lane, and that that sewer drains to the west,
and that there is an additional sewer located to the easterly side
of the lot which drains to the east. It is my understanding that no
sever exists on the casement described in the very last paragraph of
the attached legal description. It is my further understanding that
It is not contemplated that such a sewer will be constructed.
In procuring the building permit for the double garage
erected on the premises, my brother, the owner of the lot, applied
for and procured a variance apparently to build the present
garage. I am not sure, again, of its precise distance from the
various lines of the lot. My brother has sold the property on a
Contract for Deed, and of course, the purchaser is concerned that if
a sever were to be constructed that the distruction of the garage or
the removal of the garage might be required; and therefore, is
desirous of having the easement described in the last paragraph of
