<br />May 12, 2022 <br /> <br />Sue Pearce <br />591 North Stream Road <br />Wayzata, MN, 55391 <br /> <br />RE: COMPLIANCE INSPECTION / NON-COMPLIANT SEPTIC SYSTEM NOTIFICATION – 1st NOTICE <br /> <br />Dear Ms. Pearce: <br /> <br />The City of Orono administers a Subsurface Sewage Treatment System (SSTS) program which regulates the SSTS <br />(commonly referred to as septic systems) within the City. On May 4, 2022, the City received a “Notice of Non- <br />Compliance” from Sewer Services, Inc., for the septic system located on your property: 591 North Stream Road, <br />based on insufficient soil separation from groundwater. The report indicated the septic system was inspected on <br />April 28, 2022; a copy of the report is enclosed for your reference. <br /> <br />According to Orono City Code, due to the septic system’s status as non-compliant, the system must be repaired or <br />replaced within three (3) years [Cite: Sec. 58-66. Inspection reports]. You should contact a septic designer or <br />installer to help you with this process; a City Septic System permit will be required. <br />Sec. 58-66. Inspection Reports. <br />(2) A notice of noncompliance shall be issued in the following circumstances and the conditions noted in violation <br />of this article shall be remedied as follows: <br />a. An SSTS determined to be failing to protect groundwater shall be upgraded, replaced, or repaired in <br />accord with Minnesota Rules Chapter 7080 or 7081, within three years, or its use is discontinued. The <br />health authority, at its discretion, may grant an extension of an additional two years. <br />b. An SSTS posing an Imminent Threat to Public Health and Safety shall be upgraded, replaced or repaired <br />within ten months. The health authority will give consideration to weather conditions in determining <br />compliance dates. If an SSTS is determined to be a public health nuisance by the health authority, the <br />health authority may order the owner of the SSTS to cease use immediately and not allow use of the SSTS <br />until it is corrected in accordance with the recommendations of the health authority. <br />For more information, please contact the City’s Septic Professional Chris Uebe.
