_.,_---
Kent and Susan Whitworth
1425 Bay Ridge Road
Wayzata, MN 55391
February 27, 1996
'MAR ; ,. .
Jeanne A. Mabusth
Planning and Zoning Administrator
City of Orono
Post Office Box 66
Crystal Bay, MN 55323-0066
DearJeanne:
As we discussed this afternoon, we hope to add a family room addition to the northeast corner of
the property at 1425 Bay Ridge Road. To-date we have taken the following steps with the city
toward this end:
• Made application for building permits for this addition.
. Discussed, amended and agreed to terms of Orono's Septic System Upgrade Agreement.
• Arranged to comply with the Performance Deposit section of the Septic System Upgrade
Agreement.
This project has the following characteristics and background:
. It is proposed for the highlighted section of the attached land survey, Attachment A. The
improvements shown on the adjacent tract A have not been performed (proposed by a
previous property owner) and are not planned.
. The addition lies 12.5 feet from the existing property line between tracts A and B, which is
non-conforming with the existing two acre zoning which calls for a 30 foot set back. We
believe the project complies with all other set back, site line and hard cover requirements.
• A percolation test for mound system design was performed on the property on November 19,
1992, by a previous property owner, and an alternate site on Tract A is shown in the
highlighted area on Attachment B. Obviously, we hope and expect this improvement will
never be undertaken, but in the event the sewer does not go through, there appears to be an
alternate site.
. The Bay Ridge neighborhood has unanimously requested a municipal sewer improvement at
the city's earliest convenience.
• Tracts A and B are under common ownership.
Our discussions with Lyle, the building inspector, on the building permit application made it
apparent, we would need to either request a set back variance on Tract B or combine the tracts.
We would rather not combine these tracts so we may maintain future options on this land.
Therefore, we wish to apply for a set back variance on tract B, unless are other alternatives that
preserve the integrity of tract A.
Best regards,
,n
% ;,'%' .,
,. , J
Kent Whitworth
