Beiison, <br /> a single person, is the owner of the property located at 1290 Arbor Street within the City <br /> of Orono (hereiilafter the "City") and legally described as follows: <br /> Lots 7 & 8, Block 1, Crystal Bay Mimietonka, Hexulepin County, Minnesota <br /> (hereinafter the"property"); and <br /> WHEREAS, the applicants have niade application to the City of Orono <br /> for a variance to Orono Municipal Zoning Code Section 78-420 Subdivision B to allow a <br /> side street setback of 21.2' where a 50' setback is nonnally required. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of <br /> Orono, Miruzesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File#04-3040. <br /> 2. T11e propei�ty is located in the RR-1B, One Family Rural Residential <br /> Zoning District which requires a niinimtun lot area of 2 acres and a <br /> minimuin lot width of Z00'. <br /> 3. The Planning Commissioii reviewed this application at a public hearing <br /> held on August 16, 2004 and recoinmended approval of the variance based <br /> on the following findings: <br /> a. The property has 12,809 s.f. (0.29 acre)in area and 100' in width. The <br /> property is witl�in the 500' — 1Q00' shoreland hazdcover zone. <br /> b. The side street is unimproved right-of-way,has been fenced and <br /> currently is being used as parkland for Crystal Bay Playground. <br /> Page 1 of 5 <br />
