� �� <br /> O ` o <br /> � � <br /> CITY of UIZONO <br /> ti <br /> ��t �G~' RESOLUTION OF THE CITY COUNCIL <br /> `�kEsKo�' rvo. 5 8 8 � <br /> A RESOLUTION TO RECONIl��ND <br /> RELEASE OF TAX FORFEITED <br /> LAND AT 1245 ARBOR STREET <br /> FOR SALE AS ONE BUILDABLE SITE <br /> WHEREAS,the City of Orono is a municipal corporation organized and existing under laws <br /> of the Sta.te of Minnesota; and <br /> WHEREAS, puxsuant to Minnesota. Sta.tutes 282, the City has received from Hennepin <br /> County notification that a parcel of land within the City has become the property of the State of <br /> Minnesota for non-payment of real estate t�es, referencing C/NC List #1493 encompassing two <br /> adjacent parcels identified as PINS 10-117-23-31-0072 and 10-117-23-31-0073; and <br /> WHEREAS, the City Council has reviewed sa.id land for compliance with local zoning <br /> ordinances,for the amount of outstanding special assessments remaining unpaid to the City,and/or <br /> for possible public use by the City as authorized in the Sta.tutes. In addition the Council has <br /> reviewed said land and certified that this parcel need not be withheld from sale pursuant to <br /> Minnesota.Sta.tutes 85.021, 92.461, 282.01, Subd. 8, 282.018, Subd. 1 or 282.018, Subd. Z. <br /> NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono, <br /> pursuant to Minnesota Statutes 282,hereby approves the classification of said parcel of Iand as Non- <br /> Conservation land, and further approves the sale of said land at public auction, with the following <br /> recommended conditions: <br /> 1. The two parcels are not individually builda.ble under existing applicable zoning ordinance <br /> provisions, including those regulations providing for minimum lot area and minimum lot <br /> width. However, lot area.,lot width,and building setback variances will be granted to a11ow <br /> the construction of one single family residence on a combination of the two parcels; the <br /> magnitude of setback variances is subj ect to City Council approval. This properry does not <br /> meet current zoning standards. <br /> 2. Release of this parcel by the City Council is subject to the condition that upon purchase the <br /> purchaser shall legally combine the two parcels into one 0.64 acre tax parcel. <br /> Page 1 of 2 <br />
