We have researched the files at City Hall, and there is much previous correspondence <br /> regarding these issues. This area was originally subdivided in 1958. A reasonable assumption is <br /> that the streets and storm sewer were constructed, at that time, before the first houses were built. <br /> According to the County tax records the present house on your property was constructed in 1970, <br /> and you purchased the property in 1992, thirty-four years after the pipe was installed. <br /> Regarding the existing storm sewer pipe and no easements for this pipe, this is typical for <br /> improvements that were constructed then. Standards and requirements for subdivisions and <br /> construction projects were less stringent then. This pipe has been in use for forty years, is necessary <br /> for drainage of the subdivision, and is allowed to remain based on the long history of continuous <br /> use. The storm drainage pipe is located in the lowest portion of the area that has historically been <br /> a drainage path for water into Forest Lake. Rerouting or removal of this pipe is not possible. <br /> According to your letter,a large cottonwood tree blew down during the May 15th severe windstorm. <br /> Hundreds of trees in the City were blown down during this severe windstorm, so this tree blowing <br /> down was not a unique occurrence. The tree was located in a low area next to the lake. Soft ground <br /> and ponded water would be expected to be found in this area. <br /> The drainage area for the storm water pipe is about ten acres and basically includes the Forest Arms <br /> Country Club Subdivision. The storm water from the subdivision properties is affecting the <br /> lakeshore and joint dock area. Because the problem is being caused by drainage from the <br /> subdivision, and correction of problem would benefit the subdivision property owners, the costs <br /> of any project to solve the drainage problems should be assessed to the properties in the drainage <br /> area. <br /> Telephone (612) 473-7357 • FAX 473-0510 <br />
