O I <br /> CITYof ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> SBO NO. 2967 <br /> kE <br /> A RESOLUTION GRANTING <br /> A RENEWAL VARIANCE TO <br /> MUNICIPAL ZONING CODE <br /> SECTION 10.28, SUBDIVISION 5 (B) <br /> FILE #1643 <br /> WHEREAS, David Nelson (hereinafter "the applicant") is <br /> the owner of the property located at 740 Willow Drive South <br /> within the City of Orono (hereinafter "City") and legally <br /> described as Lot 11, Block 1, Webber Hills, Hennepin County, <br /> Minnesota (hereinafter "the property"); and <br /> WHEREAS, the applicant has applied to the City for a <br /> renewal variance to Municipal Zoning Code Section 10.28 , <br /> Subdivision 5 (B) to permit the construction .of an attached two <br /> stall garage to be located 21' from the side lot line where a 30' <br /> side lot line setback is required. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of <br /> Orono, Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #1643. <br /> 2. The property is located in the RR-1B Single Family Rural <br /> Residential Zoning District. <br /> 3. The Orono Planning Commission reviewed this application <br /> on May 20, 1991, and recommended approval of the renewal <br /> variance based upon the following findings: <br /> A) The proposed location of the new garage is <br /> appropriate for the following reasons: <br /> i. The existing well is .located directly behind <br /> the existing carport, hence expansion to the rear <br /> corner of the house is not practical. <br /> ii. Attaching the garage in place of the carport <br /> would still require a side setback variance and <br /> would place the main existing entryway to the r <br /> house inside the garage. The proposal leaves an - <br /> entry walkway between the garage, providing a more <br /> usable, formal entryway. <br /> Page 1 of 4 <br />
