The City was under a moratorium for wetland development projects and City permits could <br /> not be issued. The grading conducted within the 0-75'setback required a conditional use permit from <br /> the City. The grading conducted may have been an extension of the temporary grading permit issued <br /> to the property in October of 2003 (Permit#P06829). Because the documentation of this violation is <br /> unclear, staff feels it would be counterproductive to review this grading project after the fact as the <br /> site is currently undisturbed and is stable. <br /> Staff is considering the violation for unpermitted work on this property closed based on the degree of <br /> work done and the site's stable condition.The site will be considered as-is for purposes of compliance <br /> with the aforementioned violation.
