1-4. 0� <br /> __.At,, CITY of ORONO <br /> "ise, t, <br /> 4 1 -..0 '4 Gti RESOLUTION OF THE CITY COUNCIL <br /> z V -' '�� 9 NO. 3713 <br /> 9kESH�g <br /> A RESOLUTION VACATING <br /> AN UNIMPROVED ALLEY WITHIN THE PLAT OF <br /> HILLSIDE PARK <br /> IN THE CITY OF ORONO, <br /> HENNEPIN COUNTY, MINNESOTA <br /> FILE NO. 2120 <br /> WHEREAS, the City of Orono is a municipal corporation organized and existing <br /> under the laws of the State of Minnesota; and <br /> WHEREAS, on February 23, 1996, Loren Brueggemann (hereinafter the <br /> "applicant") filed a petition with the City of Orono requesting the vacation of an unimproved <br /> public right-of-way adjacent to his property and originally dedicated in the plat of Hillside Park, <br /> Hennepin County, Minnesota in 1912 and legally described as follows: <br /> that part of the east-west alley as platted in "Hillside Park", according to <br /> the recorded plat thereof, Hennepin County, Minnesota, which lies <br /> southerly and adjacent to Lot 12, Block 1, said "Hillside Park", Hennepin <br /> County, Minnesota; and <br /> WHEREAS, after due published and posted notice, a public hearing was held <br /> by the City's Planning Commission on March 18, 1996, regarding said vacation and all <br /> interested persons were given an opportunity to be heard; and <br /> WHEREAS, after due standing and consideration, the Planning Commission <br /> recommended unanimous approval of the proposed vacation; and <br /> WHEREAS, the City Council of the City of Orono finds that said vacation as <br /> proposed is in keeping with the public interest and in consideration of the following findings: <br /> 1. The majority of the 10' alley is located within the lake bed of Lake Minnetonka <br /> below the Ordinary High Water Level of 929.4. The entire western portion of <br /> the alley is located within the lake bed restricting land access to the limited <br /> eastern portion of the alley from Westlake Street. <br /> Paae 1 of 2 <br />
