Olson (hereinafter "the applicant") is the owner of the <br /> property located at 2601 West Lafayette Road within the City of Orono and legally described <br /> as follows: <br /> Tracts C and F, R.L.S. No. 131, Files of Registrar of Titles, Hennepin County, <br /> Minnesota (hereinafter "the property"); and <br /> WHEREAS, the applicant has applied to the City for variances to Municipal <br /> Zoning Code Section 10.22, Subdivisions 1 (A) and 2 to permit the installation of a new patio <br /> area adjacent to a pool entirely located within the 0-75' setback area that will be located 24' <br /> from the shoreline where a 75' setback is required and where the existing patio is located 24', <br /> the patio shall be installed with interlocking pavers placed in a sand bed resulting in 1,046 s.f. <br /> of hardcover where 1,216 s.f. exists and where none is allowed. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono. <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #2040. <br /> ?. The property is located in the LR-1B Lakeshore Residential Zoning District <br /> requiring one acre in area. The property consists of 60,000± s.f. or 1.37 acres. <br /> 3. The Orono Planning Commission reviewed this application on July 17, 1995 and <br /> recommended approval of the variances as proposed based upon the following <br /> unique findings and hardships: <br /> A. Over 50% of the area of this property is located within the 0-75' setback <br /> area. <br /> B.
