Purpose. The purpose of the this document is to outline the understanding between the Property Owner and <br /> the City of Orono regarding the restoration of the driveway at the subject property with respect to the 2018 West <br /> Lafayette Road Reconstruction Project. <br /> 2. Background. As a result of the 2018 Road Reconstruction Project on West Lafayette Road, the driveway <br /> access at 2615 West Lafayette Road to the road was restored by the City's contractor. The property owner claims <br /> the restored driveway is too steep for proper access. <br /> 3. Special Consideration. Rather than having the city contract to adjust the driveway grade, the property owner <br /> has agreed to include any adjustments as a private driveway re-pavement project. In consideration for a full and <br /> final release the City will pay the Property Owner $ 2,750.00 for the adjustment to the grade of the driveway. <br /> 4.Release. In consideration of the payment by the City, Property Owner hereby releases the City of Orono, its <br /> elected officials, employees, agents and insurers, and affiliated agencies and organizations('`Released Parties") <br /> from any further claims related to the driveway restoration claim. The property owners acknowledge and agree <br /> that the City intends to adopt, by way of compromise and accord, a full and final settlement relating to the Claim <br /> with the understanding that the City has agreed to pay the consideration set forth herein strictly as a business <br /> accommodation to avoid the uncertainty and expense of litigation and resolve the Claim without any admission of <br /> liability. <br /> City of Orono Project Representative: Property Owner: <br /> /9-3,_11 •f - 71//5/79 <br /> Adam T.
