The following regular members were <br />present: D. V. Judkins, rim. A. Curry, II. S. Rice <br />and A. K. Simonson; absent: W. W. Wolfe and <br />D. S. Cleveland. Ex- officio member present: <br />K. Turnham. <br />Mr. J. L. Braff was present requesting recommenda- SUBDIVISION <br />tions on the division of Lots 15, 21, and the J. L. BRAFF <br />S.W o half of Lot 20, Shore Hills. -The chair read <br />a petition carrying the signatures of eight <br />property owners in the immediate area opposing <br />the proposed subdivision. The chair also read <br />two letters dated January 21 and 22, 1965'from <br />Iierbert P. Lefler, attorney representing .ter. Braff. <br />After considerable discussion A. K. Simonson moved <br />to recommend that the Village Council obtain a <br />legal opinion on how binding deed restrictions are <br />on the Village, and to check the legal aspects of <br />a previous subdivision of the Jacobs property in <br />the same area, between Lafayette Road and the <br />channel, as it bears on the matter in hand. <br />Wm. A. Curry seconded the motion and it passed -by <br />a majority, with D. W. Judkins abstaining. <br />W. S. Kelley, Jr. was present with a plan for the SUBDIVISION <br />subdivision of the Ruth Herrick property located W; S. KELLEY, JR. <br />in the S. E. quadrant of the intersection of the ]RUTH HERRICK <br />Old Long Lake- 4layzata Road and the Minn. Western PROPERTY <br />R. R. The proposed plan divides the six acres <br />into six sites ranging from 37,350 sqo ft. to <br />409780. The danger of setting a precedent in <br />establishing less than one acre lots in this <br />area was at scussed. x, x., uimonson moved recoca- <br />mending approval of the plat.. H. S. Rice seconded <br />the motion and it was passed by a majority with <br />D. W. Judkins voting nay, <br />The petition of Mr.. Norman Berglund and :tr. Paul VACATION OF <br />Berggren for vacation of that Dart of ,ebb Street PORTION OF <br />lying between Lot 1 of Coffee °s Addition and WEBB STREET <br />Lot 149 Fagerness Point was discussed. It was <br />pointed out that the steep grade of this portion <br />of 'ri ebb Street made it unusable. H. Sa Rice' moved <br />to recommend vacation. D. W.
