j CITY of ORONO <br /> Post Office Box 66•Crystal Bay,Minnesota 55323•Munici�a Offices <br /> i <br /> - On the North Shore of Lake Minnetonka <br /> April 13, 1990 <br /> Dean and Dori Qunell <br /> 280 Tonka Avenue <br /> Long Lake, MN 55356 <br /> Re: Inquiry regarding garage construction on "300 Tonka Avenue" <br /> Dear Mr. & Mrs. Qunell: <br /> Thank you for your letter of March 27th, regarding <br /> construction of a detached garage on property located to your <br /> south at "300" Tonka Avenue, also known as Lots 17 and 18, Block <br /> 5, Bayside Addition to Lake Minnetonka. <br /> Lots 17 and 18 are separated from your homestead parcel by a <br /> 40' dedicated road right-of-way, platted as "Hill Street". While <br /> this road has never been developed, the dedicated right-of-way <br /> still acts to separate your homestead parcel from Lots 17 and 18. <br /> If Hill Street could be legally "vacated", its ownership would <br /> revert to the abutting property owners. <br /> I have been informed by the Public Works Department that <br /> they recommend against a vacation of Hill Street at least until <br /> the Stubbs Bay area sewer issues have been resolved, since there <br /> is a possibility that the Hill Street right-of-way would be <br /> necessary for sewer construction. <br /> The Orono Municipal Zoning Code prohibits construction of a <br /> detached structure on a parcel that does not -have a principal <br /> structure. Lots 17 and 18 fall into that category, and, even <br /> though your house would be nearby, technically a garage would not <br /> be allowed on the separated tract. <br /> Your options would appear to be as follows: <br /> 1. Request a vacation of the portion of Hill Street between <br /> your homestead parcel and Lots 17 and 18. Since this would <br /> not have a positive recommendation from City staff, it is <br /> unlikely that such a vacation would be allowed by the City <br /> Council. <br /> 2. Request a variance to allow construction of the garage <br /> on a separated parcel.
