The City received your letter dated July 16, <br /> 2014, and the $50.00 check you enclosed. The letter stated as follows: <br /> I James Barth of 3725 Togo Rd, appeal the 78-1577 ordnance <br /> violation. I am in full compliance of this ordnance. <br /> Based on your letter, it is unclear to the City what action you intend to appeal. Over the <br /> past few years, you have attended several court hearings regarding your compliance <br /> with Orono City Code Section 78-1577. On February 10, 2011, you pleaded guilty to <br /> Count 1: Exterior Storage pursuant to Orono City Code Section 78-1577. As part of <br /> your sentence, the judge ordered you to follow the conditions of your probation. On <br /> June 16, 2014, the Honorable Ivy S. Bernhardson found that you violated the terms of <br /> your probation. On July 18, 2014, the Honorable Charles A. Porter denied a motion <br /> you filed regarding the probation violation. <br /> The Orono Zoning Board of Appeals and Adjustments ("Board") does not have <br /> any authority to overturn any decision made by the court. If you wish to appeal any <br /> judicial decision, you must do so in court. The Board only has the following powers: <br /> (1) To hear and decide appeals from any affected person where it <br /> is alleged that there is an error in any order, requirement, <br /> decision or determination made by an administrative officer <br /> in the enforcement of this chapter. <br /> (2) To hear requests for variances in accordance with this <br /> chapter. <br /> (3) To exercise other functions as provided in this chapter. <br /> Orono City Code § 78-96(a). <br />
