The stairway manufacturer <br /> argues that as a second stairs it is not required to meet Code. Uniform Building Code Section <br /> 3306f1 (also enclosed) states, "Every stairway having two or more risers serving any building <br /> or �ortion tllereof shall conform to the requirements of this section.° The stairway manufacturer <br /> also argues lhat the treacl width is close enough to the required 7'/z" at 12" from the post. 'l�he <br /> 1'ielel insPection clone by Bruce Vang found a tread width of 4'/z" measuring correctly from <br /> nosing to nosii�g of lhe tread (sce enclosure fram �Ianc�book to the Uniform Building Cocic). <br /> "I'he stair�vay manufacturer would like to include the tread width under the next step. If tread <br /> wicltli was measured in this fashion, you could build a ladder and call it a conforming stair. <br /> The stairway manufacturer has stated he would like to bring the matter to the Orono Building <br /> Cocie I3oard of Appeals. The function of the Board is to hear and decide appeals of orders, <br /> clecisions or cietei-minations macle by the Building Offieial relative to the application ancl <br /> interpretation of the Code. The Board has no authority to waive requirements of the Code. <br /> Therefore, since it is clear that the stairs does IlOC meet Cocie anci it is not a matter of <br /> interpretation, the City will not accept an application to the Board of Appeals. The Ci[y must <br /> require the stair to be removed and replaced with a stair that meets Code. A deadline of June <br /> l, 1995 has been establis(ied for compliance.
