Mack and Ardell Mack, husband and wife <br /> (hereinafter "the applicants") are the owners of the property located at 1580 Sixth <br /> Avenue North �vithin the City of Orono (hereinafter the "City") and legally described as <br /> follows: <br /> Tract D, R.L.S.No. 1418, Herulepin County, Minnesota <br /> (hereinafter the "property"); and <br /> WHEREAS, tlie applica�lts have inade applicatio�z to the City of Orono <br /> for a conditional use permit per Orono Municipal 7oning Code Section 78-966 <br /> Subdivision A to allow for the construction of a berm within the property along Sixth <br /> Avenue North. <br /> NOW, THEItEFORE BE IT RESOLVED by the City Council of <br /> Orono, Miiuzesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File#04-3Q34. <br /> 2, The propei-ty is located in the RR-1B, One Family Rural Residential <br /> Zoning District which requires a minimum lot area of 2 Acres and a <br /> minimum lot width of 200'. <br /> 3. The Planning Commission reviewed this application at a public hearings <br /> held on July 19, and August 16, 2004 and recommended approval of the <br /> conditional use permit based on the following findings: <br /> a. The applicants will meet all of the standards and conditions of City <br /> Code Section 78-1286 Subdivision E. <br /> Page 1 of 5 <br />
