This investigation revealed that <br /> a retaining wall has been constructed below the ordinary high water <br /> elevation (OHW) of 929 . 4 ' (NGVD, 1929) for Lake Minnetonka, and <br /> that you had no valid DNR permit which authorized any such <br /> alteration. The action, therefore, constitutes a misdemeanor <br /> according to Minnesota Statutes, Chapter 103G. 245 and is punishable <br /> by fines up to $700. 00 and/or 90 days in jail. <br /> In order to be in compliance with State rules, you have the <br /> following alternatives: <br /> 1) Voluntarily remove the retaining wall, restore the lakebed <br /> to its original cross-section and condition, and submit a <br /> minimum $100 inspection fee. A written schedule for the <br /> restoration must be submitted for approval by the DNR along <br /> with a check or money order made payable to the Department of <br /> Natural Resources for $100. <br /> 2) Apply for an after-the-fact permit to retain the work you <br /> have completed (a set of permit application forms is enclosed <br /> for your use) . It is possible Lha�i �he per�«�t nY�11Cay'i.iOil <br /> would be denied in all respects, or that conditions may be <br /> placed upon the permit. In the case of after-the-fact permit <br /> applications, the normal application fee is doubled and a <br /> minimum $100 field inspection fee is charged. Using the <br /> enclosed fee worksheet, please calculate the normal fee and <br /> submit a check or mor�ey order, payable to the Department of <br /> Natural Resources, for double that amount, plus $100. <br /> You are advised that you must comply with all rules, regulations, <br /> requirements or standards of other applicable federal, state, or <br /> local agencies and units of government. Compliance with DNR rules <br /> and regulations does not preclude compliance with other <br /> authorities.
