We concluded that because of the variances granted in 2000 for the second story <br /> addition, even if there was no change in the overall amount of hardcover or structural coverage a <br /> variance would be required. <br /> After the agent left I noticed a stop work order issued in May, 2007, concerning an expansion of <br /> the lakeshore deck. A copy of the order is enclosed. There was nothing in the f le to indicate <br /> the order had been satisfied. The agent indicated that you were considering selling the <br /> property. If a potential buyer were to review the file a likely question would be the status of this <br /> order. Since the deck expansion violated the 75 foot lakeshore setback as well as the structural <br /> coverage and hardcover limits allowed by the variance the City's interest in the matter is more <br /> than simply the lack of a building permit for the work. I had the building inspector check your <br /> property He reports the deck expansion is still in place. <br /> I apologize if the lack of follow up for nearly three years created the impression that the deck <br /> expansion could remain without any further action on your part. That is not true. Your choices at <br /> this time are: <br /> 1. Remove the deck expansion (including the hot tub)to bring the property into compliance <br /> with the approvals granted in 2000. A copy of the resolution and copy of the approved <br /> site plan are enclosed. This will not require a permit unless structural alterations were <br /> made to the portion of the deck that will remain in place. <br /> 2. Apply for variances to allow the deck expansion to remain. If you are successful you <br /> would then need to obtain a building permit. You may find information about variances <br /> at the City's website (www.ci.orono.mn.us), by stopping by City offices, or by requesting <br /> a packet be sent you (952-249-4620 or planning@ci.orono.mn.us). You have the right to <br /> apply for a variance. However, I would note that the Council is reluctant to approve <br /> structural coverage and lakeshore setback variances.
