Fritz (hereinafter the "Developer") is owner of the <br /> properties within the City of Orono (hereinafter the "City") located at 3805 & 384� North Shore <br /> Drive and 1635 Shadywood Road, legally described as follows: <br /> Exhibit A, attached <br /> (hereinafter the "Property"); and <br /> WHEREAS, on October 19, 2005 the Developer filed a formal subdivision <br /> application with the City for preliminary approval of a five-lot residential plat of the Property; <br /> and <br /> WHEREAS, after due published and mailed notice in accordance with Minnesota <br /> Statutes 462.3�8 et, seq. and the City of Orono Zoning and Subdivision Codes, the Orono <br /> Plannin� Commission held public hearin�s on November 21, 2005 and on February 21, 2006 at <br /> which times all persons desiring to be heard concerning this application were �iven the <br /> opportunity to speak thereon; and <br /> WHEREAS, at its regular meeting of February 27, 2006 the Orono Cit�� Council <br /> considered the subdivision application of the Developer; and <br /> WHEREAS, the City Council hereby makes the following findin�s in re�asd to <br /> this application: <br /> FINDINGS <br /> 1. This application was reviewed as ZoninQ File #OS-3161. <br /> 2. The property is zoned LR-1C Single Family Lakeshore Residential District, <br /> which requires a minimum lot area of 0.5 acres and minimum lot width of 100'. <br /> The Property is 3.87 acres in area, of which 0.09 acres is wetland and 3.78 acres is <br /> non-wetland area. Each proposed lot meets or exceeds the 0.50 acre minimum <br /> with the two proposed back lots meetina or exceedin� the 0.7� acre minimum. <br /> Pa�e ] of 9 <br />
