They are the grantors of the W. & M. DOCHERTY LIVING TRUST, dated September 06, <br /> 2017 (hereinafter referred to as the "Trust"). <br /> 2. The names of the grantors of the Trust are WARREN G. DOCHERTY and MARY E. <br /> DOCHERTY. <br /> 3. The names of each original trustee of the Trust are WARREN G. DOCHERTY and MARY <br /> E. DOCHERTY. <br /> 4. The name and address of trustees empowered to act under the trust at the time of execution of <br /> this certificate are: <br /> WARREN G. DOCHERTY and MARY E. DOCHERTY <br /> 2540 Sandstone Lane <br /> Orono, MN 55356 <br /> 5. Homestead Tax Treatment <br /> a. The property legally described on Exhibit"A" attached hereto and made a part hereof <br /> (the "Propert�') is claimed as homestead far Minnesota property tax purposes and is <br /> located at 2540 Sandstone Lane, Orono, MN 55356. <br /> b. The persons entitled to be treated as the owners of the Property are WARREN G. <br /> DOCHERTY and MARY E. DOCHERTY because (i) they are the occupants of the <br /> Property and the grantors of the Trust and(ii) the Trust remains unconditionally <br /> revocable during the lifetime of WARREN G. DOCHERTY and MARY E. <br /> DOCHERTY and a revocation of the Trust would cause legal title to the Property to <br /> revest in WARREN G. DOCHERTY and MARY E. DOCHERTY as grantars of the <br /> Trust. <br /> c. Article Four, Section l.a of the Trust contains the following provisions: <br /> During our joint lifetimes, our Trustee shall pay to, or apply for, the benefit of a <br /> Trustor all or such part of the income and principal of such Trustor's respective <br /> Contributive Share as such Trustor may direct. <br /> 6. The trustees are authorized by the trust to sell, convey,pledge, mortgage, lease or transfer <br /> title to any interest in real or personal property, except as limited by the following: NONE. <br /> 7. The Trust reserved in the grantors the right to revoke or terminate the Trust. As of the date <br /> hereof, the grantors have not terminated or revoked the Trust. <br /> 8. The grantors represent that the statements contained in this Certificate of Trust are true and <br /> correct and that there are no other provisions in the Trust that limit the powers of the trustees <br /> to sell, convey,pledge, mortgage, lease, or transfer title to interests in real or personal <br /> property. <br />
