SUBDIVISION 8 <br /> FILE NO. 2643 <br /> WHEREAS,Patrick M.Burton and Kirsten M.Burton,(hereinafter"the applicants") <br /> are the owners of the property located at 2601 Rainey Road within the City of Orono (hereinafter <br /> "the City") and legally described as follows: <br /> Lot 3, Block 1, TREES TO BE and Outlot B TREES TO BE, CITY OF ORONO, <br /> Hennepin County, Minnesota(hereinafter "the property"); and <br /> WHEREAS, the applicants have applied to the City for a variance to Municipal <br /> Zoning Code Section 10.55, Subdivision 8 to permit the construction of a private drive�vay through <br /> a�vetland ��here no fill is normally allowed. <br /> WHEREAS, after due published notice and mailed notice in accordance �vith <br /> l��innesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Plarulin; <br /> Cummission held a public hearing on November 20, 2000, at which time all persons desiring to be <br /> heard concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as ZoninQ File #2643. <br /> '�. The property is located in the RR-1B Zoninj District,�vhere 2 acres or 87,120 s.f. is <br /> the minimum required lot area. The property consists of approximately 13.86 acres. <br /> 3. The Orono Planning Commission revie«-ed this application on November 20, 2000 <br /> and recommended approval by a vote of 6 to 0. <br /> �.
