Attached are engineering comments, please protect the septic sites as noted. Also attached is an escrow agreement.
Please have the property owner sign and return with a check for$2,500.
Your project may trigger the Minnehaha Creek Watershed District's (MCWD) permitting requirements; please contact
the MCWD directly at 952-471-0590 regarding your project. Please note, the City of Orono will not issue a building
permit without a copy of MCWD permits or documentation from the MCWD stating the proposed project does not
trigger any of their permitting requirements. The above information is required in order for the plan review to
continue.
Finally, the private road Pine View Drive must have a minimum of an approved base coat before the building permit will
be issued. We have informed the developer.

Dear Christine,
As requested, we have completed an engineering review of the documents submitted for the above
referenced project. Our current review is based on the following submittal items:
• Certificate of Survey prepared by Gronberg and Associates, dated 5/19/14
• Building Plans, dated 6/26/14
We offer the following observations, comments, and recommendations far your consideration:
1. Protection fencing should be installed around the proposed septic sites to ensure they are adequately
protected during construction.
2. The silt fence and septic site protection fencing should be installed and inspected by the City prior to
any land disturbing activities. The Contractor must provide a minimum 24 hour notice prior to
inspection.
3. A financial security of$2,500 from the Applicant is recommended for erosion control and
engineering oversight. The financial security is intended to provide protection in the event that it
becomes necessary for the City to install or maintain erosion and sediment control within the project
area and covers the cost of vegetation re-establishment if the applicant is unable to follow through
with the conditions of approval.
4. The applicant will be required to obtain Minnehaha Creek Watershed District(MCWD) approval and
permitting for their Erosion Control Rule. A copy of any approvals or permits required should be
submitted prior to any work.

Melanie:This was also shown to be a pad. We showed grading for the garage in front and some grading on the sides.
The rest of the house area fit in with the natural grades so that was left untouched but the floor elevations are clearly
marked just like the other pads.

All:
OK— now having taken a look at the approved grading plan I believe our initial analysis is correct. This lot, Lot 2, did not
have a specific, created building pad approved with the Plat as Lots 1 and 4 did. The proposed garage elevation and
walkout elevations on Lot 2 are consistent with the approved grading plan but the rest of the plan must also conform —
basemen, height, stories, etc.
Please see Chris's initial comments and submit a revised plan. If you have further questions or would like to discuss the
plans in our office please let me know.

Mark,
All buildings in Orono must not exceed 2 %2 stories. In determining the number of stores, we subtract 6-feet from the
main floor elevation (shown as 1004.5'), which is 998.5'. This existing 998.5' contour is the contour with which we
determine story vs. basement. At least 50% of the basement perimeter must be below the existing 998.5' contour...if
not, the lowest level will be considered a story and the home will be defined as three stories. Attached is our drawing
highlighting the portion of the perimeter which meets the 6 foot threshold. The portion 6-feet or more in existing grade
appears not to have enough lineal footage to meet the City's basement requirements. Therefore this is defined as a
three story home and is not permitted. Please revise the house to meet the 2 %2 story requirement or lower the home so
more than 50%of the basement perimeter is 6-feet from the main floor.
Once we receive an updated, survey and/or building plans, our review will continue. Please note, the engineer nor
building office have reviewed this application yet, so there may be additional changes required. If you have any
questions, please don't hesitate to contact us.
Also please note,a building permit will not be issued until the base course for Pine View Drive is installed and
approved.

OK— now having taken a look at the approved grading plan I believe our initial analysis is correct. This lot, Lot 2, did not
have a specific, created building pad approved with the Plat as Lots 1 and 4 did. The proposed garage elevation and
walkout elevations on Lot 2 are consistent with the approved grading plan but the rest of the plan must also conform —
basemen, height, stories, etc.
Please see Chris's initial comments and submit a revised plan. If you have further questions or would like to discuss the
plans in our office please let me know.

not, the lowest level will be considered a story and the home will be defined as three stories. Attached is our drawing
highlighting the portion of the perimeter which meets the 6 foot threshold. The portion 6-feet or more in existing grade
appears not to have enough lineal footage to meet the City's basement requirements. Therefore this is defined as a
three story home and is not permitted. Please revise the house to meet the 2%2 story requirement or lower the home so
more than 50%of the basement perimeter is 6-feet from the main floor.
Once we receive an updated, survey and/or building plans, our review will continue. Please note, the engineer nor
building office have reviewed this application yet, so there may be additional changes required. If you have any

Mike will be dropping off the check and the escrow agreement today FYI.
In your email you mentioned for building permit to be issued a minimum of an approved base coat is needed. Is
that the gravel compacted base coat or a top coat of asphalt? I talked to Ron Olson the contractor doing the
development road wark and he is doing a roll test thursday and hoping to get compaction and rock down friday
night or saturday. If that is the case can we get the permit tuesday of next week to start the site inspection,
excavation etc?
I appreciate your help on this, i'm trying to schedule my crews and its been a challenge with timing.
Let me know what else you need from me, I had also asked for the permit dollar amount if you could let me
know that would be great.

Your project may trigger the Minnehaha Creek Watershed District's (MCWD) permitting requirements; please contact
the MCWD directly at 952-471-0590 regarding your project. Please note, the City of Orono will not issue a building

ORONO, a Minnesota municipal corporation ("Cit�') d Michael 8 Lori Vanyo("Owners").
Recitals
1. Construction of the new residence located at 1135 Pine View Drive the ("Subject
Propert�'), legally described as Lot 2, Block 1, Pine View in Orono, Hennepin County
Minnesota, is the subject of building permit application number #201400690 has been
com pleted.
2. Winter conditions currently prohibit completion of exterior improvements, final grading,
and vegetation establishment. An as-built survey cannot be accurately conducted at this
time.
3. Owners request the City issue a temporary cert�cate of occupancy ("TCO�) to the
Owners so that the Owners may occupy the new residence.
4. The City will issue a TCO only if the Owners establish an escrow to ensure completion of
exterior improvements, continuation of erosion control and submittal of an as-bui� survey
to the City.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $10,000 with the City. All accrued interest, if any, shall be paid to
the City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to assure completion of any
exterior improvements, final grading, establishment of vegetation as well as guarantee reimbursement to
the City for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of
$500, or legal consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent
with expenses the Owners would be responsible for under a building permit application. The escrow will
also guarantee reimbursement to the City for all out-of-pocket costs the City has incurred to assure that
the work is completed in accordance with the Stormwater Pollution Prevention Plan and the provisions of
Orono City Code Chapter 79. The financial security may also be used by the City to eliminate any
hazardous conditions associated with the work and to repair any damage to public property or
infrastructure that is caused by the work (including planning, engineering, or legal consultant review)
associated with building permit #2014-00690 if compliance with the approved building permit is not
accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will
in tum send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of
the Owners' receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make
payment to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners
pay all expenses invoiced pursuant to#3. The City may draw from the escrow account without further approval
of the Owners to reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to
the Owners when all requirements related to the project are complete. C�y Staff shall review the terms of
this escrow agreement two times per year to determine whether the requirements of the project have
been successfully completed and whether it is appropriate to retum the funds. Owner may also request
the release of the funds, and such funds shall be released upon City Staff receiving the appropriate
verification that all requirements of the project have been successfully completed.

4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when alt requirements related to the project are complete. City Staff shall review the terms of this escrow
agreement two times per year to determine whether the requirements of the project have been successfully
completed and whether it is appropriate to return the funds. Owner may also request the release of the funds,
and such funds shall be released upon City Staff receiving the appropriate verification that all requirements of the
project have been successfully completed.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subje� pursuant to Minn. Stat. §§415.01 and 366.012.

not grant permission for additional or related work which requires sepazate
