Sec.13.04 RIGHTS OF SUBJECTS OF DATA
Subdivision 1. Type of data. The rights of individual on whom the data is stored or to be stored shall be as
set forth in this section.
Subd. 2. Tennessen warning. An individual asked to supply private or confidential data concerning the
individual shall be informed of: (a) the purpose and intended use of the requested data within the collecting
government entity (b) whether he may refuse or is legally required to supply the requested data; (c) any known
consequence arising from his supplying or refusing to supply private or confidential data; and (d)the identity of other
persons or entities authorized by state or federal law to receive the data. This requirement shall not apply when an
individual is asked to supply investigative data, pursuant to section 13.82, subdivision 7,to a law enforcement officer.
Subd. 3. Access to data by individual. Upon request to a responsible authority or designee, an individual
shall be informed whether the individual is the subject of stored data on individuals, and whether it is classified as
public, private or confidential. Upon further request, an individual who is the subject of stored private or public data on
individuals shall be shown the data without any charge and, if desired, shall be informed of the content and meaning
of that data. After an individual has been shown the private data and informed of its meaning, the data need not be
disclosed to him for six months thereafter unless a dispute or action pursuant to this section is pending or additional
data on the individual has been collected or created. The responsible authority or designee shall provide copies of
the private or public data upon request by the individual subject of the data. The responsible authority or designee
may require the requesting person to pay the actual costs of making and certifying the copies.
The responsible authority or designee shall comply immediately, if possible, with any request made pursuant
to this subdivision, or within ten days of the date of the request, excluding Saturdays, Sundays and legal holidays, if
immediate compliance is not possible.
Subd. 4. Procedure when data is not accurate or complete. (a) An individual subject of the data may
contest the accuracy or completeness of public or private data. To exercise this right, an individual shall notify in
writing the responsible authority describing the nature of the disagreement. The responsible authority shall within 30
days either: (1) correct the data found to be inaccurate or incomplete and attempt to notify past recipients of
inaccurate or incomplete data, including recipients named by the individual; or (2) notify the individual that the
authority believes the data to be correct. Data in dispute shall be disclosed only if the individual's statement of
disagreement is included with the disclosed data.
The determination of the responsible authority may be appealed pursuant to the provisions of the
Administrative Procedure Act relating to contested cases. Upon receipt of an appeal by an individual, the
commissioner shall, before issuing the order and notice of the contested case hearing required by chapter 14, try to
resolve the dispute through education, conference, conciliation, or persuasion. If the parties consent, the
commissioner may refer to the matter to medication. Following these efforts, the commissioner shall dismiss the
appeal or issue the order and notice of hearing.
(b)Data on individuals that have been successfully challenged by an individual must be completed, corrected,
or destroyed by a government entity without regard to the requirements of section 138.17.
After completing, correcting, or destroying successfully challenged data, a government entity may retain a
copy of the commissioner of administration's order issued under chapter 14 or, if no order were issued, a summary of
the dispute between the parties that does not contain any particulars of the successfully challenged data.

The city received a new set of house plans and surveys for 2789 Pheasant Road. I understand from your

The Perimeter below grade above 6' main floor offset is: 237'-2" (146'-3" exposed lower level)
Approx: 45'-5 1Z2" linear feet over 50% minimum.

It appears this will be a three story house as the lowest level appears to be a defined'�story"and not a"basement".
Without a First Floor Elevation shown on the survey I used the TFE and added 2'for trusses— if this is not correct please
provide first floor elevation. This results in the 949.2'contour being used for the basement determination (6' is
subtracted from the first floor elevation...). The lowest floor is therefore not a basement.
If your intent was for the upper level to meet the half-story definition I will need more detail —cross sections, wall
heights, etc. The half-story definition is below.

Basement means that portion of a building that is partly or completely below the existing ground level. A
basement shall be considered as a story for purposes of determining the number of stories in a building, when
the finished surFace of the floor above the basement is more than six feet above the existing ground level for
more than 50 percent of the basement's perimeter. The perimeter of the basement does not include portions of
the house or garage that do not have a lower level but are merely "unexcavated". Artificially raising the grade
adjacent to the foundation of a structure (by filling or by a combination of filling and retaining walls) above the
surrounding natural terrain shall not be allowed as a method for converting a defined story to a defined
basement, regardless of any other benefits to the property of such action. Finished grade that increases more
than one foot from existing ground level shall be considered as artificially raising the grade. However, artificially
raising the grade when such action merely restores a previously excavated site to its original natural grade
may used as a method for converting a defined story to a defined basement.
Building height means the vertical distance between the highest adjoining ground level at the building or ten
feet above the lowest ground level, whichever is lower, and the top of the cornice of a flat roof, or the deck line
of a mansard roof, or the uppermost point on a round or other arch-type roof, or the median height of the
highest gable of a pitched or hipped roof. Topographic changes which elevate the adjoining ground level above
the existing terrain shall not be considered in determining building height. For a pitched or hipped roof
situation, regardless whether the highest living space in a building is a half-story or full story, if the highest
living space contains windows (excluding skylights) the upper measur ing point for defining building height shall
be the median height of the top of the highest window and the highest peak of the roof.
Story means that portion of a building included between the upper surface of a floor and the upper surface of
the floor or roof next above. It is measured as the vertical distance from top to top of two successive tiers of
beams or finished floor surfaces and, for the topmost story, from the top of the floor finish to the top of the
ceiling joists or, where there is not a ceiling, to the top of the roof rafters. A story that meets the definition of a
"basement" shall be considered as a basement and not as a story for purposes of determining the number of
stories in a building.
Half story means the uppermost floor of a building in which (i) the intersection of the exterior wall and the roof
is not more than three feet above the floor elevation, and (ii) not more than 60 percent of the floor area within
the exterior walls of the uppermost floor exceeds five feet in height as measured from the floor to the rafters.
Floors exceeding these parameters shall be deemed a full story.

I think the decorative panels is something the client dreamt up. Think vents. But they wanted them to look a bit more like
windows,without being windows, as there is nothing behind them. They can simply be called out as vents—feel free to
redline them. I do not have a photo, as it's only been a conversation thus far.
I'll have the surveyor take a look at the other survey and drainage related items and will get back to you asap.

I have reviewed the building permit for a new residential property at 2789 Pheasant Rd and have the following concerns:
• The survey shows a 6" PVC storm pipe extending down the slope ultimately discharging close to the lake. This
pipe should daylight at or before the 75' setback.This would not be allowed without a Conditional Use Permit
(CUP).
• Additional grading needs to be shown on the northeast corner of the house to reflect the drainage being
maintained on the existing property. The 948 contour will need to be adjusted and potentially additional survey
will be required to show the proposed grading plan can maintain a swale down this property line.
• I believe the intent of the drainage on the east side of the property is to drain to the low area south of the
house. Has the proposed 6" pipe been designed by a registered professional engineer to make sure it can
handle the runoff from a 100yr event(rainfall or snowmelt)without impacting the proposed structure? This will
need to be signed off by a registered professional engineer.
• The retaining wall on the southwest corner exceeds 4' in height. The applicant will need to submit plans and
specifications from a registered professional engineer for the retaining wall.
• The silt fence shows it is extending significantly into the 0-75' zone. Will this area be re-seeded or re-sodded? Is
it the intent of the applicant to regrade to install sod or seed? If so this should also be included in the earthwork
calculations. If the calculation exceeds 10 CY, a CUP will be required.
• Are all the easements shown on the survey? Along the north side of the property there is an existing watermain
and sanitary sewer, but no easement is shown. This should be included on the survey.

I have reviewed the building permit for a new residential property at 2789 Pheasant Rd and have the following concerns:
• The survey shows a 6" PVC storm pipe extending down the slope ultimately discharging close to the lake. This
would not be allowed without a Conditional Use Permit (CUP).
• Additional grading needs to be shown on the northeast corner of the house to reflect the drainage being
maintained on the existing property. The 948 contour will need to be adjusted and potentially additional survey
will be required to show the proposed grading plan can maintain a swale down this property line.
• I believe the intent of the drainage on the east side of the property is to drain to the low area south of the
house. Has the proposed 6" pipe been designed by a registered professional engineer to make sure it can
handle the runoff from a 100yr event(rainfall or snowmelt)without impacting the proposed structure? This will
need to be signed off by a registered professional engineer.
• The retaining wall on the southwest corner exceeds 4' in height. The applicant will need to submit plans and
specifications from a registered professional engineer for the retaining wall.
• The silt fence shows it is extending significantly into the 0-75' zone. Is it the intent of the applicant to regrade to
install sod or seed? If so this should also be included in the earthwork calculations. If the calculation exceeds 10
CY, a CUP will be required.
• Are all the easements shown on the survey? Along the north side of the property there is an existing watermain
and sanitary sewer, but no easement is shown. This should be included on the survey.

Property"), legally desc�lbed as Tr�t A, RLS No. 310 in Orono, Hennepin County
Mlnnesota, is the subject of building permit applicatlon number 2012-01206 has been
com�leted.
2. WiMer conditions currently prohlbit comptetion of exterior improvements, final grading,
and vegetation establishment. An as-built survey cannot be s�ccurately conducted at this
�me.
3. Ow�ners request the Ciry issue a temporary csrtificate of occupancy ("TCO") to the
Owne�s so that the Owners may occupy the new residence.
4. The City wiil issue a TCO only if the Owners establish an escrow to ensure compietlon of
exterior improvements, continua�on of erosion control and submittal of an as-built sunrey
to the City.
NOW THEREFORE�THE PARTIE8 AOREE AS FOLLOWS:
1. DEP�OSIT OF E3CROW FUNDS. Contemporaneousiy with the execution of this Escrow
Agreement, the Owners shall deposit 510,000 with the City. All axrusd interest, �f any, shall be paid to
the City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is t� assure completion of any
exte�or improvements, final qrading, establishment of vegetatlon as well as guarantee reimbursement to
the City for aU ou#-0f-pocket costs the City has incumed (including pianning, engineering, in exc�ss of
$500, or legal consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent
with expenses the Owners would be responsible for under a building permit application. The escrow will
also guarantee reimbursement to the City for all out-of-pocket costs the City has incurred to assure that
the work is cximpleted in acc�ordance with the Stormwater Pollution Prevention Plan and the provisions of
Orono Ctty Code Chapter 79. The financial security may also be used by the Ciiy to ellminate any
hazarrlous conditions assocfated with the work and to repair any damage to public propert�+ or
infrastructure that is caused by the work (including planning, englneering, or iegal cansultant review)
associateti with bullding pennit #2012-01206 if compliance with the approved building permit is not
accomplished.
S. MONTHLY BILLING. As the City receives consultant bills for incumed costs,the City will
in tum send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of
the Owners' recelpt of bilL

6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible
expenses incurred by the City exceed the amount in escrow, the City shall have the right to certify the
unpaid batance to th�subject property pursuant to Minn.Stat. §§415.01 and 366.012.
7. ACCESS TO SUBJECT PROPERTY, The Owners hereby grant to the City, its agents, �
employees, officers�nd contractors, the right to enter upon the subject property for the specific purpose
of inspecting and completing any exterior improvemenfis, final grading, establishment of vegetation and

1. A building permit application has been filed for construcfion of a new home located at 2789
Pheasant Road, the ("Subject Propert�l'), legally described as Tract A, RLS No. 310, Hennepin County
Minnesota.
2. Owners request the City to review this application.
3. The Ciry will commence its review of the application and incur costs assoaated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FO�LOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement,U�►e Owners shall depos�$2,500 with the City. All aaxued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow acoount.

to the City within the timeframe outlined in#3 above,shall issue a Stop Work Order until the Owners pay all expenses
