Dear Sven:
This is to follow up our visits in regard to your building the house for Mr. and Mrs. Teynor.
We expected that we would have difficulty any time you build a house and we understand that,
however,there are some things that concern us greatly.
1. Over the years the road on the west end of our property used to be further away from
our property line, however, I noticed now it moved closer and we would appreciate if
you would:
a. Move the dumpster next to our property so the people are driving on the right side
of the dumpster. The reason for this is that we had our trees trimmed and they said
that we may lose that large maple tree because the road has been moving closer to
it.
b. Behind our shop I noticed that a lot of dirt has moved in and we need to get that
scraped out so in the winter when the snow comes we don't get any water in the
building.
Many years ago we did have that whole back blacktopped so it eliminated any water
from coming in to the shop.
Also on the north end the irrigation people needed to break up part of that black top
because they had to reroute the irrigation line. This needs to be blacktopped again.
2. A lot of clay has moved in from the driveway area onto our lawn and we would like to
have that all removed.
3. The hedge is pretty well gone so we will have to put in a new hedge and we want to
make sure any dirt on our property that needs to be filled in will be good black dirt.
4. Our main concern is that our natural drainage from Teynor's property. For example,
when we had the 15 inch rain several years ago we had no problems at all with water
because everything from Teynor's property drained down the steps and we didn't have
any standing water at all.
What is the plan for this drainage?
In conclusion, we want to make sure all of that hard surface now drains onto their property and
not onto our property and we would appreciate if that was done immediately because every
time it rains now we get a little more clay.

Dear Roger:
It was nice having a chance to visit with you on the phone in regard to the problems we have
had with water flooding onto our property. The reason for this problem is that the landscaping
company, Yardscapes, has not put in the swale 15 to 18 inches below the rock wall which they
said they would construct.
In the fall of 2013 the contractor, Sven Gustafson of Stonewood,John Sather of Yardscapes,
Mrs. Gail Teynor who owns the property at 2789 Pheasant Road in Orono, Lyle Oman from the
City of Orono and Lee Sundet met.
Lyle asked the landscaper how they were going to solve the problem of the water and mud
running onto the Sundet's property (2791 Pheasant Road).
The landscaper said they would put up a rock wall and there would be a swale between the
rock wall and the Teynor house so the water drains to the lake.
Lyle said that would be acceptable.
The rock wall was not completed until the fall of 2014. On October 2"d Mr. Oman brought Bob
Bean and showed how they had not built the wall and the swale according to plan. Also Lyle
Oman said he was there when he saw the water running onto Sundet's property and it was very
evident the rock wall was not high enough and did not have the proper swale to drain the water
toward the lake.
Bob Bean wrote a letter dated October 10th confirming it had not been built to plan.
On October 30th Lee Sundet wrote to John Sather of Yardscapes and asked how high the
boulders would be above the swale.
On November 3rd lohn Sather replied the swale would be 15 to 18 inches above the rock wall
and also said they would install the swale.
On November 18th John Sather wrote and said they had corrected the draining wall.
When Lee Sundet returned in late May he went over and noticed there was no swale 15 to 18
inches as was promised in 2013 and as Mr. Oman and Mr. Bean requested. All Sundets are
asking is for the swale to be at least 15 or more inches deep and wide enough along the wall so
it can drain all the water to the lake.
